10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.


NOTE:**



Having an interior elevator is not feasible due to small interior spaces for the 620 NE 76th Street building. Creating an exterior elevator is not possible due to the site constraints that would adversely affect both the existing use and existing accessibility.
The second floor and mezzanines of the 7541 Biscayne Blvd building were permitted when they were built and we ask that they be allowed to remain.

If the waiver is denied, second floor space would become un-usable, at considerable expense for the owner for the 620 NE 76th Street building.
If the waiver is denied, the existing permitted mezzanines and second floor of the 7541- 7551 Biscayne building would have to be removed.

Site constraints exist that limit the feasibility of vertical accessibility without adversely affecting the existing use of the building and its existing ground floor accessibility of the 620 NE 76th Street building.
Existing mezzanine and second floor of the 7541- 7551 Biscayne Blvd building were permitted when constructed and are not being enlarged. We ask that they be allowed to remain.
