Obtaining vertical accessibility for this project would be both cost prohibitive and structurally unfeasible. With this building being a non-conforming structure from 1926, the following applies -No footprint alterations are allowed by right as per Section 7.2.3 "Alterations and Expansion of Nonconforming Structures," which means that it is technically infeasible to install the lift from the outside of the building without altering the building foot print. The only location where it might be possible to install a vertical accessibility lift is inside the building. We explored this possibility but this would result in the loss of approximately 40% of leasable space square footage at the ground level which would consequently impact the viability of the project.

Substantial financial costs will be incurred by the owner if the waiver is denied. The owner has made a diligent investigation into the costs of compliance with the code, but cannot find an efficient mode of compliance. Description:

The cost estimates for obtaining vertical accessibility exceed the 20% of total cost threshold. Furthermore, it is unfeasible to install external vertical accessibility or for any other such system, such as a "chair lift" system, as the staircases are not wide enough to accommodate such a system.
• We strongly believe we do qualify for an exception to provide vertical accessibility after spending 20% of the remodeling cost for accessible features, and based on the unreasonable hardship to provide vertical accessibility and considering the following:
1. The cost of providing vertical access being between $47,000.00 and $52,649.00 or 50% of the cost of the entire remodeling. 
2.The cost of all construction contemplated being $ 97, 000.00.
