Description:

The Surf Club is a locally designated (by a Certified Local Government)historic landmark. It includes a space on the second story for which the only means of access is a single historic stair tower. The square footage amount shown above reflects the Hemingway Office which is the second story space that is the subject of this application.

The Hemingway Office is a room that is part of a large historic resort that has undergone significant historic preservation projects and some additions that are unrelated to the Hemingway Office. Those other elements do not share the same "path of travel" that provides access to the Hemingway Office ("Primary Function Area") from the accessible ground floor and should therefore not be part of the disproportionate cost calculation.

The Hemingway Office project consists of alterations to a discrete area served by a single path of travel that is just now being prepared for construction. Until the final design and use for the space was determined, an application for a waiver would not be ripe; however, it is now.

Applicant requests the Commission waive the requirement set forth in Section 553.509, Florida Statutes and Section 201.1.1 of the Florida Building Code-Accessibility that would otherwise require vertical accessibility be provided from the accessible ground floor to the Hemingway Office in the historic Surf Club.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. NOTE:**


The Surf Club is a unique historic oceanfront property. The Hemingway Office space is a a second story space that does not communicate with with any other second story spaces and has only one path of travel from the accessible ground floor-- the historic stair tower. The dimensions of the stair tower and the historic character of the space directly below the Hemingway Office space are such that providing vertical accessibility would either not be possible (technically infeasible) or would threaten or destroy the historic significance of the Surf Club.




There is not a technically feasible means of providing vertical accessibility and an accessible route from the accessible ground level to the Hemingway Office that would not threaten or destroy the historic significance of the Surf Club. Therefore, if a waiver is not granted that would allow the Hemingway Office to be occupied and used, the owner will suffer a significant loss of sales and service area (since the Hemingway Office would remain unused and unproductive space). In addition, the cost to provide vertical accessibility to the Hemingway Office is disproportionate to the cost of the alteration to the Hemingway Office at approximately 50% of the cost.
