We are seeking a waiver from Section 553.509 of the Florida Americans with Disabilities Accessibility Implementation Act, which requires Petitioner to provide vertical accessibility to all levels above and below the occupiable grade level of a building. Specifically, we are requesting a waiver from providing vertical accessibility to the second floor of an existing building.

Substantial financial costs will be incurred by the owner if the waiver is denied. The owner has made a diligent investigation into the costs of compliance with the code, but cannot find an efficient mode of compliance. Provide detailed cost estimates and, where appropriate, photographs. Cost estimates must include bids and quotes.
Description:
The financial hardship is based on the disproportionate cost of providing accessibility to the second floor of our existing office building in conjunction with a build-out of the interior space. Construction of the new office space will cost $153,243 including all plans, permits, materials and labor. The additional cost of installing a passenger elevator in conjunction with this project would be $107,800, which would amount to a 70% increase in the total cost. As detailed in the attached bids, this estimate is based construction of a legal hoistway that is properly framed and enclosed, and installation of the elevator and associated equipment.
