The building was built in 1985 prior to Florida's vertical accessibility requirements in 1993. The metal stairs are in disrepair and must be replaced. However, Florida statutes require vertical accessibility when alterations are being made to an area containing a primary function or a path of travel. The cost of including an elevator would be disproportionate to the cost of the proposed repair and remodel which would cause extreme hardship. Therefore, we are requesting a waiver from Florida Statute 553.509 down to the Federal ADA Standard Requirements.

Florida Statute 553.509 requires vertical accessibility to all buildings that are not specifically excluded pursuant to Sec 553.509(1)(a)-(g). However, Florida Statute 553.512 allows a waiver if an applicant for a waiver demonstrates economic hardship in accordance with 28 C.F.R. s. 36.403(f)(1).

The proposed project is to replace 2 exterior stairs, which are in significant disrepair, with enclosed concrete stairs and to upgrade a portion of the exterior facade of the building. The total estimated cost of the proposed project is $94,400. The estimated cost of adding an elevator to provide vertical accessibility is approximately $70,000. Accordingly, the cost to comply with Florida Statute 553.509 and provide vertical accessibility greatly exceeds 20% of the total cost of the alterations and pursuant to ADA Standard Requirements is disproportionate to the overall project.

Comments:

The owner has requested to replace the two existing metal stairs with concrete stairs and upgrade the front elevation. The accessibility code would require an elevator to be installed. However, the cost to install the elevator and enclosure would far exceed 20% of the cost of the alteration, the required amount to be spent on improvement to accessible route. Therefore we are requesting a Waiver of this requirement.
