Original structure was not ADA compliant. County is requiring replacement structure to be ADA compliant. There's concern about liability if replacement structure is ADA compliant because there's no parking access near structure. This is not a public dune walkover; but, making the replacement structure ADA compliant would risk the safety of those persons using the replacement structure because the location is directly off of a busy highway. The financial costs to make the replacement structure ADA compliant is not within the current owner's means.

Creating a vertically accessible structure could create risk for the owner given that it may entice disabled persons to park along the highway to access such a structure. Doing so wouldn't be safe.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. NOTE:**


An ADA ramp system at the project location is not supportable because there is not ADA parking on a busy highway. If project was to be too attractive as an ADA dune walkover without safe parking boundaries, the owner would be liable for any injuries or deaths resulting from its use by a disabled person.



The current owner cannot afford to build an ADA compliant dune walkover. The cost to construct an ADA compliant dune walkover is $24,000.
