Grounds for waiver.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**

Existing restrooms predate Accessibility requirements, and accessible stalls will be created by removing adjacent fixtures. Walls surrounding these restrooms are structural, and the restrooms cannot be expanded. Even with removing fixtures, the new stalls allow room for floor clearance at the toilet, but not enough for adding lavatories. Accessible lavatories are available in the restroom, outside of the stall.

Comments:

We are requesting a waiver to the Florida Accessibility Code (FAC) requirement to place a lavatory sink in every Accessible toilet stall. This project is an alteration of a set of existing restrooms that predate Accessibility requirements, and accessible stalls are being created by removing adjacent toilets/urinals to the limit of fixture count requirements. This strategy provides enough room for the required floor clearances for the Accessible toilet, but falls short of allowing space for lavatory sinks to be installed while maintaining the required 60" clearance from the toilet. The walls of the restrooms are structural, supporting a mechanical mezzanine, and the restrooms cannot be enlarged. Accessible lavatories are provided in each restroom, outside of the accessible stall.
