During plan review, the zoning administrator for the City of West Palm Beach indicated that an accessibility waiver is required for the press box.

In this case, Florida law exempts occupiable spaces and rooms that are not open to the public and that house no more than five persons, including, but not limited to, equipment control rooms and projection booths.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. NOTE:**




Florida Statute 553.509 exempts occupiable spaces and rooms that are not open to the public and that house no more than five persons, including, but not limited to, equipment control rooms and projection booths. Additionally, the 2010 ADA Standards for Accessible Design, ADA Chapter 2, Section 206.2.7 specifically exempt press boxes in bleachers that have points of entry at only one level if the aggregate area of the press box is less than 500 square feet. Here, the proposed press box is an occupiable space/room only 288 square feet, is not open to the public, houses no more than 5 persons with equipment, and is accessible only at one level at the top of bleachers. As such, the proposed press box is exempt under both Florida and federal law.





Substantial financial costs will be incurred by this not-for-profit university if the waiver is denied. The elevator alone is estimated to cost $235,300. This cost is in addition to the cost of the ADA bleachers ($170,000), the city required sidewalk that ties into Military Trail including ramps and detectable mats ($60,000), the ADA restrooms and showers ($16,000) and the ADA drinking fountains ($4,000).
