Caribbean Shores Waterfront, LLC, purchased the property in late 2016. At that time, the Egret and the Ibis buildings each had one staircase that provided access to the 2nd floor. The Egret building has 12 rooms on the 2nd floor, and the Ibis building has 6 rooms on the 2nd floor. The Egret has 12 rooms on the ground floor and the Ibis has 6 rooms on the ground floor. For both the Egret and the Ibis buildings, the rooms on the 2nd floor are identical to the rooms on the 1st floor. Even the view of the inter-coastal waterway on the east side of the buildings is available from the rooms on the 1st and 2nd floor. Therefore, a lift to provide access to 2nd floor should not be required.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.


NOTE:**



Requiring a lift to serve the 2nd floor of the Egret and Ibis buildings would burden the property owner unnecessarily because the 9 rooms on the 2nd floor of these buildings (6 rooms in Egret and 3 rooms in Ibis) are exactly the same as the 9 rooms on the 1st floor. By "exactly the same" we mean the rooms are identical in size, identical in shape, and identical in use. The existing and proposed floor plans, and pictures of the 1st and 2nd floor rooms, are attached.

Based on the 2 proposals attached, the minimum cost of the lift and installation would be $36,700. The cost to install the lift is 30 percent of the Company's $121,680 maintenance and improvement costs (not including the $57,440 spend to repair the roof of the Egret building earlier this year). The lift would provide access to the 2nd floor, but since the rooms on the 2nd floor are identical to the rooms on the ground floor, the benefit would be marginal in light of the high cost.
