Alteration of an existing 1 story restaurant with existing employee only mezzanine area. Scope of new work includes interior fit out of new dining area, kitchen area, new accessible ramp and addition of a dining mezzanine with <50 occupants.

While the mezzanine meets all criteria of ADA 2010, Florida Statute 553.509 is the governing section that applies in this jurisdiction. Given the spatial limitations both of the space and the size of mezzanine (which seats <50 occupants), addition of vertical transportation is not feasible due to program below which includes a manager's office and employee locker area (both required to be accessible). While not an active permit comment, we did discuss with the building inspector who referred us to the Commission to complete this process.

In addition, given the size of the mezzanine about, addition of vertical transportation and associated required clearances will dilute usable square footage to an area where construction of the mezzanine does not make operational sense as minimal seating will be feasible. Extensive structural and envelope work will also be required to install vertical transportation. Per section 2 of 553.509, we request waiver down to ADA 2010 Standards which the proposed mezzanine meets.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. NOTE:**



Given the spatial limitations both of the space and the size of mezzanine (which seats <50 occupants), addition of vertical transportation is not feasible due to program below which includes a manager's office and employee locker area (both required to be accessible). In addition, given the size of the mezzanine above, addition of vertical transportation and associated required clearances will dilute usable square footage to an area where construction of the mezzanine does not make operational sense as minimal seating will be feasible. We request per Section 2 of 533.509 that condition be waived down to ADA 2010 which this mezzanine meets (<25% of total seating and similar dining experience, furniture, and finishes. Required accessible seating is spread throughout both dining rooms.




The total cost of adding a vertical transportation system for the proposed mezzanine is estimated to be more than $1,000,000 (Quote 1: $1,159,747; Quote 2: $1,080,543). Total construction cost excluding this scope of work is $3,257,085. The scope of adding a vertical transportation system would add approximately 35.6% to the overall construction cost. While the cost is not the main driving factor for our request, it is disproportionate to the rest of the project budget given the limited area and program served by the elevator.
