We are converting the use of a unit on 2nd level from R-2 occupancy (long term) to R-1 occupancy (short term). Although not required to be ADA compliant except for a new 32" clear opening entry door as there is a ground level ADA UNIT 10A currently being converted. There is no area available to add an elevator on the property to be within the setbacks. The building official states that a visitor who is handicap would be unable to visit the 2nd level change of use unit. Code only requires one ADA unit in the entire building.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. All units are privately owned which can't be altered and the only possible location of an elevator outside the setbacks would occur in the middle of the only accessible hallway to the units & staircases.




The one unit owner triggering his change of use would be responsible for the entire cost v.s. all other 19 condo unit owners being accessed their prorated share.
The unit owner would need to purchase the adjacent units @ both levels if available to locate a new elevator. Market value of both units are $397,000. The cost of the elevator construction would be $60,885. The total amount would be $457,885.
