Grounds for waiver.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**

The owner wishes to convert existing Floor 2 shell space in the hangar so that it can be used by its pilots for them to do paperwork and relax during their downtime at the airport. The area will not be open to the public. Because the Federal Code of Regulations and the Federal Aviation Administration requires pilots to be able bodied, it is requested that the ADA requirement for vertical accessibility be waived. Fidelity pilots are classified as Airline Transport Pilots and are required to hold first class medical certificates per FAR 61.23(a).

Need Additional Space

The budgeted cost for the interior improvements is $139,862. It is estimated that the cost of adding an elevator would be about $40,000 to $45,000.

Comments:
Fidelity National Financial pilots are classified as Airline Transport Pilots and Federal Code of Regulations 61.23(a) requires that they hold a first class medical certificate. Because of this we believe it is reasonable to waive the FAC requirement for vertical accessibility to this Floor 2 space.
