Description:
The Cavalier is a historic Art Deco boutique hotel built in 1936 and renovated in 2008 – 2009. The Cavalier features 46 suites situated on the first through third floors, a full service bar, restaurant, with a rest area; all located in the lobby, a sidewalk café on the ground level, and a below ground level basement located in the Miami Beach Architectural District/ Ocean Drive-Collins Avenue Historic District.

The City of Miami Beach will issue a conditional building permit for renovation of the First through Third Floors provided we seek and obtain a waiver of Chapter 11-4.1.6(k)(iii). Renovations of The Cavalier Hotel will only be made to the interior 46 hotel suites situated on the First through Third floors (renovations are not being made to the Basement, Lobby, Reception area or Elevator).

The project consists of a 4 story historic hotel with 46 guest rooms. This structure is a qualified historic building under the federal ADA regulations, the ADAAG and chapter 11 (11-4.1.7) of the FBC. All of the guest rooms are situated on the upper 3 levels of the building. The first floor, which contains guest rooms, is located several risers above the accessible lobby level. There is an existing elevator that provides access from the lobby to the 2nd and 3rd upper floor guest rooms, however the elevator does not provide accessibility to the first floor nor the basement level. Florida Law states that Vertical Accessibility to all levels must be provided as required by Florida's statute 553.509. Please waive the requirement of providing accessibility to the first floor and basement.

The interior dimensions of the existing elevator cab is 42 inches length by 44 inches wide (deep) and therefore does not meet the minimum requirements as required by section 11-4.10.9 of the FBC. To meet the current size requirements, it would be necessary to demolish the shaft and equipment in order to rebuild. In doing so, we will threaten the historic structure of our building. We are kindly asking to please waive the requirement for the inside cab area to be no smaller than 48 inches by 48 inches.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. NOTE:**



It is technically infeasible to expand the elevator and provide vertical accessibility to all levels without threat or damage to the historical significance of the building. When ready for use, the historic elevator door and vintage metal gate must be opened by hand; the door swings open towards the user and the vintage metal gate must be closed to arrive to the destined floor level. The elevator itself is a historical feature and may not be modified.

If the waiver is denied the cost of providing vertical accessibility will be disproportionate to the cost of construction. The lower bid, of the two attached estimates, will represent over 20% of the cost of renovation. The cost to install the elevator and construct its infrastructure would be a substantial increase in overall cost of hotel improvements.
