FEATHER SOUND CORPORATE CENTER II, 2nd Floor Restroom Renovation

 

Issue:  Construction of accessible toilet stall using configuration 30(e).

 

Analysis:  The applicant is requesting a waiver from having to alter an existing toilet room stall to comply with Figure 30(e) in two toilet rooms undergoing $35,000 alterations each.  According to the applicant, if Figure 30(e) is used, it will result in a loss of fixtures, rendering the property available for lease less desirable.  Section 11-4;17 permits the use of Figure 30(a) in alterations, which is achievable within the parameters of the existing building configuration.

Items to be Waived:

 

11-4.17.3     Exception.  New construction. 

 

(1)    The standard accessible restroom stall shall contain an accessible lavatory within it, the size of such lavatory to be not less than 19 inches wide by 17 inches deep nominal size and wall mounted so as not to overlap the clear floor space areas required by Section 11-4.17 (see Figure 30(a) and Figure 30(e) and to comply with Section 11-4.19 of the code,  Such lavatories shall be counted as part of the required fixture count for the building.  .

 

 

Waiver Criteria:  There is no specific guidance for a waiver of this requirement in the code.  The Commission’s current rule, authorized in Section 553.512, Florida Statutes, provides criteria for granting waivers and allows consideration of unnecessary or extreme hardship to the applicant if the specific requirements were imposed.
