Upon receipt of comments from the Structural Plan reviewer at the Town of Davie requiring vertical accessibility, it was determined that a waiver should be pursued. Appropriate accommodations have been made to provide the same services on the ground floor as well as the mezzanine.

We are requesting to waive the requirement to provide vertical accessibility to the mezzanine addition. The addition is a duplication of employee services, due to the employee locker, vending, and seating amenities all remaining duplicated on the ground floor. This mezzanine and area below it are restricted to employee only and represent less than 2% of the total building square footage. These spaces are typically occupied by 30-35 employees at any given time, roughly 1/3 of the active shift. Costco as a corporation is renowned for their commitment to equity for their employees, and we believe the scope of work in this project is in keeping with those principles as well as current Florida accessibility code without providing an elevator or lift. Appropriate accommodations have been made.

NOTE:**
The hardship is caused by the interpretations made by a structural building reviewer who is requiring the modification of the mezzanine occupancy from an ancillary Mercantile Occupancy to an A-3 assembly occupancy and thusly, qualify for vertical accessibility. This mezzanine, which represents less than 2% of the Mercantile SF, by Costco protocol can be occupied by a Maximum of 35 occupants at any given time. These occupants are all employees, and the space is off limits to the general public. By rule, no more than 1/3 of active shift employees can be on a break at the same time. Despite this, the reviewer is insisting that we list 152 occupants per 1/15 A-3 occupant load factor. This is now triggering the requirement for vertical accessibility which will be a hardship to the owner.
Comments:
We are requesting a waiver and exemption from the Florida Building Commission requirement to provide vertical accessibility to the proposed mezzanine addition. The proposed addition will provide a duplication of accessible employee services (lockers, vending and seating amenities) currently provided on the existing ground floor of the building.
