The meeting of the Florida Building Commission was called to order by Chairman Raul Rodriguez at 8:30 p.m., on Tuesday, May 2, 2006, at the Sheraton Safari Hotel, Lake Buena Vista , Florida .

WELCOME

Chairman Rodriguez welcomed the Commission and gallery to the first day of the May 2006 plenary session of the Florida Building Commission. He encouraged anyone who wished to speak on issues to be concise and sign the attendance sheet.

REVIEW AND APPROVE AGENDA

Mr. Blair conducted a review of the meeting agenda as presented in each Commissioner's files.

Commissioner Wiggins moved approval of the meeting agenda as presented. Commissioner D'Andrea entered a second to the motion. Vote to approve the motion was unanimous. Motion carried.

REVIEW AND APPROVE MARCH 21 & 22 MEETING MINUTES AND FACILITATOR'S REPORT

Chairman Rodriguez opened for corrections or changes to the minutes of the March 21 & 22, 2006 Commission meeting.

Commissioner Griffin moved approval of the meeting minutes as presented. Commissioner D'Andrea entered a second to the motion. Vote to approve the motion was unanimous. Motion carried.

REPORT ON PANHANDLE WIND BORNE DEBRIS STUDY (DR. LARRY TWISDALE, ARA, AND DR. KURT GURLEY, THE UNIVERSITY OF FLORIDA )

Chairman Rodriguez stated the 2005 Florida Legislature debated whether to revise the windborne debris region in the Florida panhandle. He continued stating there has been consensus on conducting a study for the area in terms of terrain and windspeeds. Chairman Rodriguez then stated the Commission voted unanimously to contract for a study to be conducted with funding being approved during the February meeting in 2006. He continued stating Mr. Richmond recently reported Senate Bill 1774 passed in the Senate then stated when the bill passes through the House, the panhandle exemption from windborne debris region will be removed from law with the Commission being authorized to then designate the windborne debris regions based on ARA modeling.

Chairman Rodriguez further stated it has been decided there will be a special one-day Commission meeting held in the panhandle region of the state to discuss the issues relating to the windborne debris designations with resulting provisions being implemented as soon as possible. He announced the special one-day Commission meeting will be convened on June 19 or 21, 2006, with a succeeding rule development workshop to be held during the July Commission meeting for the purpose of integrating the windborne debris region designation into the Code Amendment process for the Florida Building Code. Chairman Rodriguez then stated the final hearing would then be held during the August 2006 Commission meeting.

Chairman Rodriguez then directed the Commission to Dr. Twisdale for a report on the windborne debris findings to date.

Mr. Twisdale presented the report of the windborne debris criteria for the panhandle through a PowerPoint presentation. (See Wind Borne Debris Criteria for the Florida Panhandle, Applied Research Associates, Inc. )

Mr. Vickery presented a report of the results from windload testing through a PowerPoint presentation. (See Wind Borne Debris Criteria – Loads, Applied Research Associates, Inc. )

Commissioner Bassett asked if ARA would be conducting research for the effects of Hurricane Wilma.

Mr. Twisdale responded stating it would be very helpful to include the data from Hurricane Wilma, however, the data is not readily available. He continued stating there was not adequate time or money to include the data in the current study.

Commissioner Wiggins asked if there had been any research on the correlation between consistent linear setbacks in terms of staggered homes as opposed to rows for future development requirements.

Mr. Vickery responded stating every set of spacing in a development produces different results.

Tim Reinholdt, Institute of Business & Home Safety

Mr. Reinholdt stated the ring/shank nail has resolved many of the problems with roofing issues. He continued stating the research is pointing to effective resolutions without great expense.

CHAIR'S DISCUSSION ISSUES AND RECOMMENDATIONS

Chairman Rodriguez announced Commissioner Corn had submitted his resignation to the governor. He expressed regret then stated Commissioner Corn has been invited to attend the July Commission meeting in Fort Lauderdale to receive a token of appreciation for his invaluable service to the Commission.

Chairman Rodriguez then addressed the Roofing TAC issue stating the committee must meet ANSI representation requirements. He announced the members of the TAC as follows: three producer members are Chris Schulte, Chair, Billy Cohen, Buck Buchanan; three consumer members are Karen Worsecht, Jeff Burton, Jimmy Buchner; and five general interest members are Mark Zehnal, Morris Schult, Jon Hamrick, Doug Murdock, and Nan Dean. Chairman Rodriguez extended appreciation to the members of the TAC and to those individuals who expressed interest in participating.

Chairman Rodriguez then announced additional TAC appointments. He stated in lieu of Commissioner Corn's resignation, Commissioner Greiner has agreed to serve as the Energy TAC chair. Chairman Rodriguez continued stating Commissioner Greiner's chair position on the Plumbing TAC would be filled by Commissioner Vann. He then stated additional positions on the Plumbing TAC would need to be filled following the governor's appointment to Commissioner Corn's seat on the Commission. Chairman Rodriguez further stated John O'Connor has been appointed to the Code Administration TAC replacing Commissioner Murdock. He then extended appreciation to all participants on the TAC's.

Chairman Rodriguez addressed the temporary building foundation issue stating the Commission has been conducting conference calls to obtain updates on Legislative activity. He expressed appreciation on behalf of the Commission to the governor and the governor's office for their continued support of the Commission and its process.

Chairman Rodriguez announced dates for work group meetings as follows: Hurricane Research Advisory Committee, July 11, 2006; Product Approval Validation Workgroup, May 3 & 4, 2006, and June 1, 2006, in Tampa; Termite Work Group, May 18, 2006, in Tampa; Energy Code Transition Study Work Group, June 22, 2006, in Cocoa Beach; Window Inspections Labels Work Group, May 31, 2006, in Tampa; and Code Amendment Process Review Work Group, Phase 2, July 10, 2006.

 

REVIEW AND UPDATE OF COMMISSION WORKPLAN

Mr. Dixon conducted a review of the updated Commission work plan. He referenced the proposed schedules for the Commission meetings in 2007 and 2008 requesting the Commissioners review the meeting dates for schedule conflicts. (See May 2006 Workplan )

Commissioner Greiner moved approval of the updated work plan with the exception of Item # 12. Commissioner D'Andrea entered a second to the motion. Vote to approve the motion was unanimous. Motion carried.

SUPPLEMENTAL HEARING ON RULE 9B-1, MANUFACTURED BUILDINGS

Chairman Rodriguez stated during the August 2005 Commission meeting a rule adoption hearing was held to implement changes to the Manufactured Buildings Rule. He continued stating the changes are intended to clarify the programmatic procedures for the Manufactured Buildings Rule. Chairman Rodriguez further stated the changes to the rule include the following sections: Procedures; Definitions; Fees; Inspections; and Insignias.

Mr. Richmond served as hearing officer and opened the supplemental hearing on Rule 9B-1, Manufactured Buildings, as noticed in the Florida Administrative Weekly. He stated the purpose of the supplemental hearing was to allow comment on the fee schedule changes. He directed the Commission to Ms. Jones for details on the changes.

Ms. Jones stated changes were being sought relating to the Insignia Fees. She stated a reduction in Insignia Fees for sheds has been requested to change the current $7 / insignia fee to $5 / insignia; for factory-built schools the change would be from the current $20 / insignia to $15 / building; then for manufactured building the change would be from the current $55 / insignia to $50 / module, to include storage buildings more than 720 square feet.

Mr. Richmond opened for public comment. No one approached for public comment.

Commissioner Wiggins moved approval to notice a proposed change for publication reflecting the revised fee schedule. Commissioner D'Andrea entered a second to the motion. Vote to approve the motion was unanimous. Motion carried.

 CONSIDER ACCESSIBILITY WAIVER APPLICATIONS

Mr. Harding presented the requests for waiver from accessibility in the order they appeared in each Commissioner's files. He stated the Council did not meet quorum and recommendations are consensus only.

Mr. Harding explained the issues relating to the waiver stating the Council recommended granting the waiver.

Mr. Harding explained the issues relating to the waiver stating the Council recommended granting the waiver.

7. Legal Services of North Florida

Mr. Harding explained the issues relating to the waiver stating the Council recommended granting the waiver since the applicant demonstrated disproportionate costs. He added the Council also requested the applicant be sensitive to the needs of the public by installing intake counters.

8. Greyhound Bus Terminal

Mr. Harding explained the issues relating to the waiver stating the Council recommended granting the waiver.

Mr. Harding explained the issues relating to the waiver stating the Council recommended denying the waiver. He stated there had been no representation from the applicant to address the Council's concerns.

Mr. Gascon noted there was a filed comment while the declaratory statement was under its first hearing. He stated Dr. Humayoun encouraged the Commission to note the life safety issues contained in Item 3 of the statement. UPDATE ON 2006 LEGISLATIVE SESSION

Mr. Richmond provided an update on Legislative activities stating the Senate had passed the bill and it is pending in the House currently. He added the bill is appearing on a special order calendar for consideration today. He stated three amendments have been filed on the bill in the House, one concerning impact fees; one pertaining to churches involved in serving the homeless or displaced in relation to the Fire Code; and the third pertaining to authorities in the Construction Industry Licensing Board as well as building officials. Mr. Richmond continued stating it is the Commission's desire that all three amendments be passed with the bill. He further stated the issue of temporary buildings had not reappeared during session. Mr. Richmond concluded by stating the issue of emergency access or backup power for elevators had proceeded in several directions resulting in complications. He explained it was perceived by one individual to belong in Chapter 553.509 pertaining to Vertical Accessibility for persons with disabilities. Mr. Richmond stated that classification is incorrect and he is making efforts to correct the category. He added he was uncertain whether the issue would get passed during this Legislative session due to the importance of the issue. Mr. Richmond assured the Commission whenever the issue does go through for consideration it would do so in the appropriate posture.

REPORT ON CODE AMENDMENT PROCESS REVIEW WORK GROUP RECOMMENDATIONS FOR 2007 FBC UPDATE

Chairman Rodriguez stated the Code Amendment Process Review Work Group, Phase 1, met on April 19, 2006, in Tampa . He stated the work group had been tasked in the short term to make recommendations concerning the Code update schedule, and in the long term to deliver recommendations to the Commission regarding enhancements to the Annual Interim Amendment and Triennial Code Update processes. Chairman Rodriguez announced the work group has developed a consensus recommendation for the 2007 Code Update schedule. He then directed the Commission to Mr. Blair for the report and recommendations.

Mr. Blair presented the report as it appeared in each Commissioner's files. (See Code Amendment Process Review Work Group Report )

Commissioner Carson asked how long printing would take for complete Code books to be available and distributed.

Mr. Dixon replied six months from the date of approval to distribution.

Commissioner Bassett stated staff's earlier date is pending on no delays or difficulties during the process.

Chairman Rodriguez concurred stating staff is optimistic that there will be no delays.

Mr. Blair then called for public comment.

Dennis Braddy

Mr. Braddy applauded the Commission for the optimistic dates then stated April 1, 2008 may not be realistic due to the timeline of delivering printed books earlier than training has been completed. He expressed support for a final date of January 1, 2009.

Jack Glenn, President, Florida Home Builders Association

Mr. Glenn expressed concern with the availability issue stating a primary issue is completing education and the availability of Code books for training. He recommended a target date for availability of the printed Code books of January 1, 2009.

Larry Schneider, AIA

Mr. Schneider expressed support for getting the Code published as early as possible then stated the January 1, 2009 date would be preferable as the implementation date.

Mr. Blair offered clarification stating the Commission appears to be in agreement for January 1, 2007, as the amendment submittal cutoff date with the printed Code available to the public April 1, 2008. He then stated the public has indicated preference for January 1, 2009 as the implementation date with staff's recommendation for implementation being October 1, 2008.

Commissioner Greiner moved approval for the following dates: amendment submittal cutoff, January 1, 2007; availability to the public, April 1, 2008; and implementation date, January 1, 2009; with the definition of publication date meaning the date the printed Code is available to the public. Commissioner D'Andrea entered a second to the motion.

Commissioner Bassett offered an amendment to the motion to adopt a 2009 Florida Building Code rather than a 2007 Code.

Mr. Richmond requested clarification concerning legal recommendations.

Commissioner Gross responded stating in the past there have been legal opinions issued relating to the 5 or Less definition. He explained the 5 or Less Definition is currently being confused with the definition in Chapter 10 resulting in many unnecessary waivers being submitted to the Accessibility Advisory Council.

Mr. Richmond stated legal would not be authorized to render an opinion of concerning the definition because it would then be an interpretation of the provisions. He continued stating the Commission has voted to eliminate interpretive authority, thus legal would not be permitted to supplant the Commission concerning the issue.

Commissioner Gross then requested for staff to be permitted to investigate the possibility to provide opinion concerning the definition.

Chairman Rodriguez asked if the definition as well as a statement clarifying the Commission's limitations regarding the issue could be published to the building officials for clarity relating to the issue.

Commissioner Browdy offered comment stating the Council has always relied on the good faith of the petitioners in terms of requests for waiver from providing accessibility.

Commissioner Corn recommended the letter include decisions the Accessibility Advisory Council has already made on specific issues.

Commissioner Gross moved approval for staff to draft a letter to be distributed to local building officials explaining the 5 or Less Definition and the Commission's limitations in terms of interpretation relating to vertical accessibility. Commissioner Carson entered a second to the motion.

Commissioner Norkunas offered comment stating the accessibility of the Sheraton Safari Hotel is not in compliance with current law. He stated the suggestion that a request be made to a hotel whose accessibility is far below what the law requires is not acceptable. He continued stating the answer is consistent compliance with federal accessibility laws and until that is accomplished the future is far from predictable. Commissioner Norkunas then stated there could be problems if the public learns the Florida Building Commission holds its meetings in hotels that are not compliant with federal ADA requirements.

Chairman Rodriguez responded stating without policing authority the Commission will continue to point out deficiencies and to pursue venues that are accessible in which to hold the Commission meetings.

Commissioner Norkunas then countered Title 2 does not allow an entity such as the Florida Building Commission to hold meetings in areas that are not accessible.

CONSIDER PROPOSED 2006 GLITCH AMENDMENTS TO THE 2004 FBC AND TAC RECOMMENDATIONS

 

Chairman Rodriguez stated during the February 2006 Commission meeting the Commission voted unanimously to consider only amendments related to hurricane provisions, glitch and standard update and correlation issues during the 2006 Annual Interim Amendment Process. He continued stating during the March 2006 Commission meeting the Commission voted unanimously to adopt the proposed Glitch Code Amendment Review Process.

Chairman Rodriguez offered a brief review of the process before directing the Commission to Mr. Blair for more detailed review. He presented the following requirements to be observed during the process:

•  Only Commissioners may pull amendments from the consent agendas for individual consideration with no automatic courtesy pulls resulting from public comment.

•  Amendments pulled from the No Recommendation To Approve and Does Not Meet Glitch will require discussion concerning why they are glitch modifications since the Commission voted unanimously that all amendments considered during the 2006 Annual Interim Amendment Process must meet “glitch” criteria.

•  All Commissioner members should be prepared to vote in one of three ways: a) in favor of the consent agenda, TAC Recommends Approval, Meets Glitch Criteria; b) against approval of the consent agenda, Not Recommended to be Approved by TAC; and c) against approval of the consent agenda, Does Not Meet Glitch Criteria, TAC Recommended Approval.

Chairman Rodriguez stressed if a Commissioner is unable to vote as recommended, he/she must decide which amendment to pull from the consent agenda for individual consideration.

Commissioner Gonzalez stated the amendment was a glitch amendment and met the requirements under hurricane response issues. He expressed support for the amendment stating hurricane protection device inspections were conducted in all the municipalities in Florida and it would be beneficial to include it in the Florida Building Code.

Commissioner D'Andrea expressed opposition to the amendment stating the Code allows for hurricane protection shutters that would be installed just before a hurricane event which could not be inspected.

Commissioner Browdy concurred stating requiring an additional inspection could be problematic when leaving the inspection at the discretion of the building official for determining what is and what is not a hurricane protection device. He stated the amendment is too broad and needs to be more specific. Commissioner Browdy then stated there are adequate means of inspections already in the Code for hurricane protection.

Commissioner Hamrick addressed Amendment # 1314 in the form of a motion requesting a modification be made due to the effects of costs for construction of public education facilities. He explained under the current Code, the students are being “double counted” in terms of fixture counts by using the square footage of the building rather than student occupancy. He continued by addressing the unisex toilet rooms issue stating there are single-use toilet facilities only in certain areas of schools, i.e., the principal's office or administration, pre-K through grade three classrooms, but not in assembly rooms. Commissioner Hamrick stated no unisex toilets would be placed in the assembly areas for security reasons and for the safety of the students. He requested only those two requirements be included in the amendment.

Mr. Gregory requested Modification # 1539 be removed from the consent agenda. He stated the modification is a update to a reference Code standard. He stated it was the agency's minimum standard that is used for reference by which hospitals, nursing homes, and ambulatory surgery centers are designed and constructed in the state of Florida . Mr. Gregory stated the edition currently referenced is the 2001 edition; the proposed amendment updates that edition to the 2006 edition, which is the current edition. He continued by submitting a letter from the Guidelines Institute Committee Chairman which read as follows:

On behalf of the Health Guidelines Revision Committee, the following statement is offered to clarify the current status of the 2006 edition. The 2006 guidelines for the design and construction of healthcare facilities is being re-numbered and re-paragraphed, but the content meaning has not changed from the final manuscript for vote made available to you on November 21, 2005.

Mr. Gregory stated the referenced document is supported by many organizations as a guideline for the design and construction of healthcare facilities and all concerns expressed by DCA staff had been resolved. He referenced an email from Mr. Dixon and Mr. Richmond stating the issues had been resolved. He then requested the amendment be considered and supported by the Commission.

Commissioner Gross stated he is involved in the design of many healthcare facilities and stressed the importance of the standard referenced in the amendment. He stated it was a glitch which initially created concerns that have since been resolved. Commissioner Gross continued stating the amendment had gained support through complete consensus and encouraged through a motion that the Commission support its approval.

Commissioner Wiggins seconded the motion to approve Modification # 1539.

Commissioner Bassett asked if the amendment would require only private rooms in healthcare facilities stating there would be a tremendous cost to the public.

Commissioner Gross responded the modification would require single-patient rooms, allowing non-private rooms when programs allow such. He stated although it is initially more expensive to build single-patient room facilities, ultimately the cost is recovered through better patient care and safety, and the hospitals have offered their support for the requirement.

Commissioner Greiner requested clarification concerning whether the Commission is considering the amendment as originally submitted, or comment 8 or comment 9.

Mr. Madani responded the vote would be for the modification as originally submitted. He explained comments 8 and 9 are additional information Mr. Gregory submitted for review.

Commissioner Hamrick stated the issue was highly debated in the Special Occupancy TAC meeting and originally he was not in support of the amendment, however, the issue of availability to the public has been resolved so he offered his support for the amendment.

Commissioner Greiner expressed support for the modification stating it appeared to be an upgrade of a nationally recognized guideline.

Commissioner Schulte asked what the TAC action was for the modification.

Ms. Ross requested the Commission consider #1717 as within the scope of the glitch amendment process. She stated the section of the Energy Code is discriminatory against asphalt shingles. She explained the requirement was implemented when white roofs were popular and stated there have been technological advances made in terms of white shingle products and they should not be discriminated against until 2009, which is when the next process would take place. Ms. Ross continued stating in lieu of the current energy situation, a product which delivers the same type of energy savings to the consumer as metal or tile should be available on the market. She concluded by stating the message to those individuals or groups who make technological advances should not be “nobody really cares.” Ms Ross encouraged the Commission to consider the amendment in the glitch cycle.

Jack Glenn, President, Florida Home Builders Association

Mr. Glenn stated the two changes would require bonding in all metal stud construction. He explained the reason stating there had been a death resulting from a technician drilling into a metal stud. Mr. Glenn stated if the wall area had been double insulated or on GFI protection as required by the Code, electrocution may not have occurred. He continued stating there would be tremendous cost involved in bonding an entire building together. He stated the NEC addresses bonding and the two amendments would require additional bonding and there was no substantiation of why it would be necessary as long as the National Electric Code is followed.

Dwight Wilkes, St. Johns County Building Department

Mr. Wilkes stated the death that occurred causing the proposed modification was an appliance installer who was installing the dryer. Mr. Wilkes continued stating the installer was attempting to drill for the dryer exhaust and hit a fault in the branch circuit that had energized the metal studs to which the metal ductwork for the dryer was strapped. Mr. Wilkes stated a simple bonding to the metal stud in the wall area would have taken the energy back to ground and the electrocution would not have occurred. He continued stating if the entire building had been constructed with metal studs, one simple bonding would satisfy the entire structure, however, the random partitions constructed with metal studs throughout a building cause the problem. Mr. Wilkes encouraged the Commission to support the modifications.

Mr. Glenn reminded the Commission the modification is a requirement of the NEC and there is no need for a Florida-specific amendment. He strongly encouraged the Commission not to add Florida amendments as a result of an isolated incident stating the proper venue for the modification to be considered is with the National Electric Code.

Commissioner Greiner stated the death occurred in his jurisdiction. He explained the situation was just as Mr. Wilkes described then stated the issue is easily solved by one of the plastic boxes being metal and attaching a metal screw to the stud to provide bonding as is required. Commissioner Greiner stated the modification is necessary in the interim until the change can be made to the NEC. He stated it is a health and safety issue for the citizens of Florida as it relates to the Code and stated the modification strengthens the Code as well. Commissioner Greiner stated there should be no deaths as a result of these situations and if there is any way to prevent deaths it should be done.

Commissioner D'Andrea expressed opposition to the amendment stating all of the facts have not been provided for the specific case causing the death of the appliance installer. He expressed great regret that a death had occurred then stated the NEC would be the proper venue for addressing the modification.

Mr. Bickford addressed Modification # 1196 stating the intent of the change was to create consistency between the Residential Plumbing Code and the statute change initiated by Senate Bill 442. He stated the Senate Bill changed Florida Statute 633.5391 with the following language:

“. . .backflow assemblies shall be inspected once every three years. . .”

Mr. Bickford stated staff simply made the change in the wrong section in the Residential Code and the change is merely correcting the error placing the requirement in the Inspections section rather than Testing.

Mr. Downs stressed the importance of the issue for the industry and concurred with Mr. Bickford's comments.

Commissioner Vann requested Modification #'s 1451 and 1196 be removed from the consent agenda. He stated Modification # 1451 seems very simple in terms of life safety issues but the industry's concerns relate to wanting to provide absolute direction in terms of how to resolve the issue. He stated the modification is a glitch because it is a life safety issue for the citizens of Florida .

Commissioner Bassett concurred stating Modification #1451 is a glitch amendment simply because staff placed language in an incorrect location in the Code.

Mr. Dixon offered clarification stating maintenance requirements are not authorized to be included in the Florida Building Code. He stated the Building Code is to provide requirements to obtain the C.O. He agreed the issue is a serious public health issue and the appropriate agencies should have the language authorizing the action that would resolve the problems.

Chairman Rodriguez requested clarification concerning the venue the industry representatives should seek for resolution.

Mr. Richmond stated when the issue was raised in 2005 he advised the proponents to take the issue up with the Housing Development Authorities. He stated in current context the Commission should not seek authority to include maintenance issues in the Florida Building Code. Mr. Richmond directed industry representatives to a local government of the county health units.

Commissioner Schulte asked if the modification should be approved in the event the law changed.

Mr. Richmond recommended the amendment not be approved stating the references will be removed from the Code.

Mr. Dixon stated all references to maintenance requirements will be removed from the Code because it is a violation of the law to include them in the Code.

Commissioner Corn agreed that the Commission would not want to get into the business of enforcing how homeowners maintain their homes.

Mr. Belcher addressed 1879 requesting an amendment stating the issue is hurricane related. He stated the issue deals with recovering roofs and proposed additional language at the beginning of #5 stating:

Shingle roof coverings installed over an existing roof or roof covering shall be designed and tested for the end-use configuration in accordance with Section 1504.

Mr. Reinholdt stated 95% of the homes that sustained enough hurricane damage to file a claim had some roof damage. He stated the products available are tested and are highly rated, however, the products have only been tested on a flat surface, new roofing deck, not on uneven or a surface where there is an existing roof. He continued stating the ARMA website warns about the application of tabs over an existing roof.

Ms. Ross stated there is a large amount of data available concerning the issue and it should be an issue for discussion and consideration by the new Roofing TAC then submitted for change during the next code amendment cycle. Commissioner Corn expressed concern regarding voting no on all the modifications removed from the consent agenda then requested clarification from the Commission on the actions.

Commissioner D'Andrea stated he voted no for the modifications because of a lack of information on the changes and the fact that the TAC has not had a chance to review the changes.

Commissioner Vann concurred then stated the Commission is not the appropriate forum for detailed review and analysis, the TAC should be relied upon for technical analysis.

Commissioner Griffin added if a member of the Structural TAC showed support for the modifications he would be inclined to support them as well.

Chairman Rodriguez called for a vote on the motion. Vote to approve the motion resulted in 1 in favor; 21 opposed. Motion failed.

Mr. Cohen stated his organization would support the modification being approved by the Commission.

Ms. Ross stated ARMA supports the modification as well.

Mr. Zehnal stated the modification provides a clear definition and offered support for the modification.

Commissioner Wiggins seconded the standing motion to approve the modification. Vote to approve the motion resulted in 18 in favor; 3 opposed. Motion carried.

Mr. Cohen stated the modification clarifies roofing requirements for the consumer in terms of insurance the appropriate scope of work required for each job.

Mr. Zehnal stated offered support for the modification stating it provides guidelines for local building departments.

Ms. Ross noted the 25% rule has been in the codes for a very long time. She expressed support for the modification.

Mr. Madani countered the 25% rule has only appeared in the Code in the HVHZ section.

COMMISSION MEMBERS COMMENTS

Commissioner Bassett expressed concern regarding supportive documents being available only electronically increasing the workload for the volunteers who serve on the Commission. He requested the supportive documents be available in hard copy as well.

Commissioner Goodloe announced the Accessibility Advisory Council has met and there may be members attending the Accessibility TAC meeting to address issues involving accessibility.
