Accessibility Waiver Summary – April 6, 2009

 

1.         Florida International University School of International and Public Affairs, 11210 SW 12th Street, Miami.   The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in three areas of the proposed new building:  2  98-seat classrooms with stadium seating and a 489-seat auditorium.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels.

 

2.         Visual and Performing Arts Teaching Facility, University of South Florida, 4202 E. Fowler Avenue, Tampa.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in two areas of the proposed new building:  A small recital hall and a larger concert hall.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels.

 

3.         Palm Beach County Fire Rescue Station No. 32, 4022 Charleston Street, Lake Worth.  Three council members recommend granting a waiver from provision of vertical accessibility to the second floor of a proposed new fire station and one member was opposed.  The basis for the waiver is that the fire station has been designed in accordance with the Uniform Federal Accessibility Standards (UFAS) which allow areas not open to the public, and in which persons with physical disabilities cannot perform the physical duties required, to be constructed without vertical accessibility.  The second floor of the fire station will be occupied only by fire fighters, and the ground floor is accessible.  This project was previously granted a waiver in January of 2008, but the station has not yet been built and the waiver expired after 1 year.

 

4.         South Florida Community College Auditorium Renovation, 600 West College Drive, Avon Park.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating and to the tiered box seats in an auditorium undergoing major renovation.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels and to the box seats.

 

5.         Southside Saddle Club, 2980 Greenbrier Road, Jacksonville.  The Council unanimously recommends granting, with conditions, a waiver from provision of vertical accessibility to all rows of seating in an existing bleacher.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.  However, the Council recommends granting the waiver on condition that an appropriately sized concrete wheelchair pad will be installed beside the bleacher within one year because there is currently no place to put a wheelchair near the bleacher except on the grass or the sidewalk.

 

6.         Remington College – Tampa Campus, 6302 E. Martin Luther King Jr. Blvd., Tampa. The Council unanimously recommends granting, with conditions, a waiver from provision of vertical accessibility to all rows of seating in a 49 seat criminal justice classroom that is undergoing renovation.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels.  The Council recommends conditioning the waiver upon moving the proposed locations of the accessible seats so that they are not on the ends of rows.

 

7.         Henrosa Hotel, 1435 Collins Ave., Miami Beach.  The Council unanimously recommends granting, with conditions, a waiver from provision of vertical accessibility to two areas of an existing three story hotel which was built in 1935 and is a qualified historic building under the ADA and the Florida Building Code.  The first area is access to the second and third floors, because the existing elevator does not meet the current elevator size requirements and installing a larger shaft is not feasible given the structural limitations of the building.  The second area is a portion of the first floor (where guest rooms are located) which is elevated from the lobby by four risers, but the hall isn’t large enough to install a lift or ramp.  The basis for the waiver is unreasonable hardship, in that provision of vertical accessibility is technically infeasible.  However, the Council recommends granting the waiver on condition that the hotel establishes a policy of giving notice to the public that the hotel does not meet all accessibility criteria, including provision of the elevator dimensions and access limitations.

 

8.         Jupiter High School, 500 North Military Trail, Jupiter.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new bleacher.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.

 

9.         Royal Palm Beach High School, 10600 Okeechobee Blvd., Royal Palm Beach.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new bleacher.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.

 

10.       La Prima Casa Montessori, 2733 SW 3rd Ave. and 281 SW 28 Rd., Miami.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to the second floors of two existing school buildings that are undergoing renovations.  The basis for the waiver is disproportionate cost.

 

 

11.       Orange County Magic Recreation Center - South Econ Site.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new collapsible bleacher system.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.

 

The next four waiver applications are identical to the one above.

 

12.       Orange County Magic Recreation Center – Golden Rod Site.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new collapsible bleacher system.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.

 

13.       Orange County Magic Recreation Center – Dr. Phillips Site.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new collapsible bleacher system.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.

 

14.       Orange County Magic Recreation Center – Meadow Woods Site.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new collapsible bleacher system.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.

 

15.       Orange County Magic Recreation Center – Silver Star Site.  The Council unanimously recommends granting a waiver from provision of vertical accessibility to all rows of seating in a proposed new collapsible bleacher system.  The basis for the waiver is unnecessary hardship, in that it is technically unfeasible to provide access to all levels of the bleacher.
