FLORIDA BUILDING COMMISSION

ACCESSIBILITY ADVISORY COUNCIL

January 31, 2011

Hilton Hotel, Tampa, Florida

The Council met with a quorum and reviewed the following applications for waivers from accessibility code requirements.

Approved:

IPIC Entertainment, 540 Riverside Drive, Coral Springs:  The applicant requested a waiver from providing vertical accessibility to all rows of seats in an entertainment complex with a bowling center, restaurant and a 9 screen movie complex undergoing an $5,500,000 renovation.  Seating is provided in both general admission and VIP sections, with food and beverage service in the VIP area.  All accessible and companion seating locations are in the VIP section, which will be available at general admission prices for those needing accessible seats.  The required number of seating locations have been provided and the Council unanimously recommended granting the waiver.

Approved with Conditions:

Wildsides Grill and Bar, 700 East Washington Street, Orlando:  The applicant requested a waiver from providing vertical accessibility to a new, raised deck in an existing two story restaurant undergoing a $50,000 alteration.  The existing first floor has 3,768 square feet with 2,208 square feet outside dining; the existing second floor has 496 square feet for the owner’s office and the new deck will provide an additional 1,547 square feet of seating.  The Council unanimously recommended granting the waiver, based on technical infeasibility, provided detailed construction cost data and estimates for vertical accessibility are provided to staff for verification.  Such costs must include construction performed for the previous three years.

Coca Cola North America, 705 Main Street, Auburndale:  The applicant requested a waiver from providing vertical accessibility to an 11,000 square foot mezzanine in an industrial beverage manufacturing facility undergoing a $2,000,000 alteration.  According to the applicant, the mezzanine would be occupied by only two employees per shift, who would operate product packaging equipment.  The applicant said the waiver is needed because the area is not open to the public and is occupied by five or fewer employees.  The Council unanimously recommended granting the waiver, provided that if any modifications are made, they must be reviewed by the local building official.

Deferred:

Miami Art Museum, 1075 Biscayne Boulevard, Miami:  The Council deferred review of the application to obtain the following information:  why accessible seats in the front of the auditorium are “alternative”; to determine if there is a stage or raised platform; to determine if the space is open to the public for other uses; confirmation of line of sight from accessible positions and if there is a movie screen provided:

Nail Bar, 1486 and 1488 Apalachee Parkway, Tallahassee:  The Council deferred review of the application so it may be appropriately noticed legally.
