6. Discuss draft rule language to allow self affirmation by providers, for advanced courses requiring minor technical changes, instead of the currently required full accreditation process.

 

The Chair asked Cam Fentriss to update the POC regarding the status of the proposed language for “course self affirmation”.

 

Cam stated that no changes have been made to the language since the last Education POC meeting. Further, she said that the proposed language has been published in the F.A.W., to be reviewed in a Rule Development Workshop at next week’s April Florida Building Commission meeting.

 

The Chair requested that the POC move for approval of the current proposed language.

7. Report on the Building Code Compliance & Mitigation Program Request for Proposal (RFP)

 

The Chair asked Ila Jones to update the POC regarding the status of this contract. Ila reported that the current contract will expire on June 30, 2010. She further stated that criteria previously developed by the POC describing the role of the Education Administrator will be included in this RFP as it was for the last RFP and contract. Procedurally, the RFP will be posted on May 4, with a closing date of May 20, with responses evaluated on May 26, and the new contract awarded so that the contract is in place by July 1, 2010. Ms. Jones finally stated that statute allows for this contract to be let for four years with one four year renewal.

SB 648 and HB 663 are moving along and this legislation should pass this session.  SB 266-272 are “shell” bills meaning they do not contain anything – they simply express legislative intent to change the law on the subject as specified – no action on these.  These bills are placeholders and may not even be used.  If scheduled for hearing, substantive legislation will be amended onto the bill at its first committee hearing.  SB 2694 contains some provisions (same or similar) to provisions in HB 663/SB 648.

 

F.  Pending issue on whether accreditation and subsequent approval process of current Accessibility course is an issue for legal counsel or can be done procedurally by Education POC – will research next month (after conclusion of legislative session).

 

Discussion

Cam Fentriss stated that SB 648 and HB 663 did contain some language remnants to eliminate the core course. She further stated that SB 2694 (Senator Constantine’s bill) has not moved at all at this point.

 

Commissioner Gregory asked if SB 2694 was a fall back bill. Ms. Fentriss stated that it appears to be, in case SB 648 and HB 663 were to “blow up”. Ms. Fentriss further stated that the reason this situation exists is because Senator Bennett has threatened to place “residential fire sprinkler systems” language in SB 648, which the Governor may not sign into law, thus the “blow up”.

 

 

9. Identify future POC member discussion items

 

Commissioner Gregory asked the Chair if there existed the means for the POC to know or make sure that courses that are accredited, are in fact being taught as they were accredited.

 

The Chair responded by stating that our rule (9B-70.002) does allow the POC (through the Education Administrator) to conduct random audits on accredited courses. The Chair further stated that if a Commissioner received a complaint, then he should submit it to the Education Administrator who would then look into its viability as a legitimate complaint. It was suggested by Cam Fentriss to make sure that any complaint was worded as specifically as possible.
