Case #4 – St. James Episcopal Church has been withdrawn by the applicant.

 

Case #1 – My Little Angels Daycare. The applicant is requesting a waiver from providing water closets for children mounted at a height of 17 to 19 inches. The Council unanimously recommended approval based on the provisions of F.S. 553.512 as unnecessary and in favor of the ADAAG Recommended Guidelines for Children's Facilities.

 

Case #2 – Condo River Golf. The applicant is requesting a waiver from providing vertical accessibility to 9 holes of a new $600,000 18 hole miniature golf course. The Council unanimously recommended approval based on the provisions of F.S. 553.512 as unreasonable with the condition that adequate signage and handouts are provided communicating how the accessible holes are played and altered.

 

Case #5 – HCH Companies, Inc. The applicant is requesting a waiver from providing vertical accessibility to the second floor of a 1930 structure that was originally built as a 3,800 square foot dwelling, which is being converted to an office use costing approximately $100,000. The Council unanimously recommended approval based on the provisions of F.S. 553.512 related to extreme financial hardship with the following conditions. The applicant is to forward to DCA staff a copy of the floor plans to verify accessible features, such as doors (including front door) corridors, conference room, ramp landings, and restrooms are located on the first floor, as well as all business functions provided on the second floor are also located on the first floor.

 

Case #6 – Cobb Theater Premium at Dolphin Mall. The applicant is requesting a waiver from providing vertical accessibility to all rows of seats in a new $2,400,000 - 5 theater movie complex. The Council unanimously recommended approval based on the provisions of F.S. 553.512 as unnecessary with the following conditions. In theater A-1, all chairs in the accessible seating row are to be relocated backwards creating the walkway in front of the accessible seating locations and companions seating. This will allow backing into the accessible seating locations due to the tight configuration. In theater C-1, the seats are to be spread out in the accessible seating row to allow for wider accessible seating locations. The modified plans are to be forwarded to DCA staff to verify compliance to the conditions.

Case #3 – South Point Park . This case was unanimously recommended for deferral for the applicant to provide additional information and adequate hardship justification. It is strongly recommended they attend the next scheduled meeting.

In other business, the Council unanimously recommended a motion to amend action previously taken on a previous case and to table for review for the February, 2007 meeting. Legal Council will provide you with the details.
