The building official has required safety glazing in a window. Safety glazing (tempered glass) is more expensive that standard glass.

The County Inspector and Seminole County Building Official stated that the 2004 Florida Building Code, Residential Commentary defines the area as “adjacent to the tub and a slip hazard because of the presence of moisture.” The building official states that even though the window is not in the building wall enclosing the tub, it still must be safety glazing because the dictionary defines adjacent as “near”.

The moisture area should be defined as the area within the tub or shower, not the area outside the tub or shower. The building wall enclosing the shower or tub should not include the wall outside the shower or tub. The window shown in the diagram should not require safety glazing.  See attached. Plus the 2001 building was different and included windows within 36 inches.
