Enter explanation of how the Petitioner's substantial interests are being affected by the local interpretation of the Florida Building Code
Local code interpretation is requiring the closure system to be mastic only at fibrous duct board to metal equipment housings, specifically an air handling unit. We are using UL-181 pressure sensitive tape which is an approved closure system as provided for in Section 603 of the code. The local building inspectors are inconsistently enforcing this misinterpretation of the code with some allowing the tape while others fail the tape. The owner/builder of the homes are incurring the added expense of re-inspection fees and down time and we are incurring the unnecessary expense of the extra travel time of having to return to mastic these connections.

We called the building department in an attempt to rectify this situation and to obtain a clear interpretation on this code issue. When confronted with the verbatim wording of the code section the building official stated that we could consider his decision a misinterpretation that he would be requiring because he felt that tape was not adequate for this type of connection. When confronted with the verbatim wording of the 2004 code Preface describing the process by which local amendments must be adopted according to a specific precess he stated that he would nevertheless be requiring mastic at this type of connection.

The code should be interpreted as written. This section of code is quite clear and to the point, with little room for misinterpretation and in fact an itemized list of what is approved. It specifies that, The approved closure methods for fibrous glass duct as provided for in the code are, 1. Heat-activated tapes. 2. Pressure-sensitive tapes. 3. Mastics or mastic-plus-embedded fabric systems. Any one of these closure systems should be allowed.
