May I express first my surprise that Staff recommended to dismiss the appeal. I thought that it was a past issue after you asked us for the deposit of the appeal... I find your answer really short giving no reference to the point past conduct of another and to the second point concerning previous code edition. You also didn't mention any alternative solution to where Florida Code Violation can be addressed and how it can be corrected? I would like to let you know that there is not only a code violation but also a case of increased risk of transmitting Legionellosis, a situation which was an actuality in New York city last summer... I guess that it will be part of the discussion Dec 1st?

I would also like to reestablish the facts which serve as background of your answer. The proposal to move and locate the tower in front of parking space 15 was first issued by Mr Steve Basset in his Feb 14th report. Last May, I performed an analysis to reduce the risks that the cooling tower transmits Legionella. I confirmed then Mr. Bassett solution in my report stating that the cooling tower should be relocated as a preventive mean to keep away a vulnerable population of elders from a source of infection, the cooling tower. This is a big difference!!! Would you please correct it before Dec 1st conference?
