TAC Objectives

Special Occupancy TAC Members Present: Chairman; Darrell Phillips, Hubert Baxter, Gene Chalecki, Ken Cureton, Frank Frail, Charles Frank, James Ginas, Bob Vincent, Wayne Young.

Special Occupancy TAC Members Absent: Mark Boutin.

Staff Present: Mo Madani, April Hammonds, Marlita Peters, Jim Hammers

Objective – To consider, discuss and provide recommendations for consideration by the Commission on the following request for Declaratory Statement.

 

Meeting Minutes

 

 

1)

Welcome and Opening Remarks. Meeting began at 8:31a.m.

2)

Roll Call was taken and a quorum was present.

3)

Review and Approval of Meeting Agenda.  Wayne Young made the motion, seconded by Gene Chalecki, to accept the Agenda as posted.  Unanimous vote of approval.

4)

Review and Approval of Meeting Minutes of October, 2014  Gene Chalecki made the motion, seconded by Charlie Frank, to accept the previous minutes of October 2, 2014 with no changes.  Unanimous vote of approval.

5)

Review and make recommendation to the Commission regarding:

DS2014-135, petitioned by Michael Ippolito, P.E. 

Petitioner, Michael Ippolito, presented the basis for his request for Declaratory statement regarding possible discrepancies between two sections of the Florida Building Code (i.e., FBC, Building Section 423.15.5 and FBC, Mechanical Section 403.3).  After lengthy discussion it was determined the petition has no particular facts and circumstances and calls for a statement of general applicability to which these sections could be applied.  Based on that information, Frank Frail made the motion, seconded by Charlie Frank, to deny this request for declaratory statement due to general applicability and provided the petitioner with several options to attempt an answer to the questions in a better format.

Other Commission business.  No other business was brought before the TAC for discussion.

7)

Public Comment.  Mr. Ippolito requested clarification of his options and how to proceed with an informal interpretation through the Building Officials Association of Florida which staff, legal and TAC members repeated their suggestions.
