Requirements to be Waived.

9. Requirements requested to be waived. Please reference the applicable section of Florida law. Only Florida-specific accessibility requirements may be waived.

Issue 1: Florida-specific hotel/motel rooms Minimum height in parking structures Accessible parking
Vertical accessibility Toilet rooms
Private Other

F.S. 553.509 Section C Vertical accessibility (c) Occupiable spaces and rooms that are not open to the public and that house no more than five (5) persons, including, but not limited to, equipment control rooms and projection booths
The 2nd floor will not be open to the public and will only be occupied by three to four (3-4) persons max

Issue 2: Florida-specific hotel/motel rooms Minimum height in parking structures Accessible parking
Vertical accessibility Toilet rooms
Private Other

F.S.553.512 Modifications and waivers, advisory council.- The Florida Building Commission shall provide by regulation criteria for granting individual modifications of, or exceptions from, the literal requirements of this part upon a determination of unnecessary, unreasonable, or extreme hardship, provided such waivers shall not violate federal accessibility laws and regulations and shall be reviewed by the Accessibility Advisory Council.

We believe that we qualify under the "unreasonable, or extreme hardship" per 553.512...."if an applicant for a waiver demonstrates economic hardship in accordance with 28 C.F.R. s. 36.403(f) (1), a waiver shall be granted"

399.02 Elevator Safety (8)The division may grant variances for undue hardship pursuant to s. 120.542
s.120.542 (2) Variances and waivers shall be granted when the person subject to the rule demonstrates that the purpose of the underlying statute will be or has been achieved by other means by the person and when application of a rule would create a substantial hardship or would violate principles of fairness. For purposes of this section, "substantial hardship" means a demonstrated economic hardship to the person requesting the variance or waiver.

Grounds for waiver.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**

Need Additional Space

The structure (offices) for which we are requesting the waiver will only require public access on the ground floor. The 2nd floor is for estimating use only. Due to the fact that we are a small family owned and operated business that relies solely on the construction industry, and are still experiencing & recovering from the financial repercussions of the 2008 housing market crash, the cost to install vertical accessibility would triple the cost of the construction of the entire structure itself and create an EXTREME financial hardship.
