3. Review and discuss both the scope and specifics of the advanced course review process by POC members.

 

The Chair asked Med Kopczynski to explain the essence of this issue.

 

Med stated that online courses are created using many different software programs. Some of the courses are basically scripted, which are fairly straightforward to accredit. However, other courses are much more sophisticated, using animation, music, movement, etc. As a result of this sophistication, Med wants to know to what level of detail the course materials should be presented to POC members for their review. For example, if a lecture is embedded in an online course, should a script of that lecture be provided for review, versus a narrative of that lecture, which is what many times they are given to review for code content accuracy.

 

Chair Browdy suggested that the conversation seemed to be focusing on the actual course delivery method, versus the accuracy of the code content.

 

Commisioner Hamrick  stated that the online course in question was easy for him to review. He also stated that he thought that the materials he reviewed as a POC member was a final product or a finished course.

 

Cam Fentriss stated that CILB board members could attend a course if they wanted to, in order to evaluate said course. She further stated that no difference should exist between attending a course and viewing the same course online, in order for accreditors and/or POC members to check for code accuracy.

 

Jane Waddel stated that current language in the rule requires that providers meet the minimum criteria of presenting to accreditors:

·        The course title and number

·        Hours of credit

·        Name, address, telephone number and email address of the provider

·        Course description completely describing what the particular course is designed to address

·        Course learning objectives

·        Course time allotments for course content

·        Course outline and instructional methods

·        Etc.

She further stated that this information should take care of this issue, and that nothing else should be required.

 

Chair Browdy asked the POC if they saw a need at this time to change the rule language to address this issue, which he viewed as an exception. All of the POC members stated that they saw no reason to change the current rule.

 

Med Kopczynski stated that his intent was not to change the rule, but rather to gain clarity regarding this issue.

 

Chair Browdy stated that no further action was needed to be taken at this time.

Med Kopczynski stated that some of the courses he accredits are not developed well, but unfortunately meet the “letter” of the rule. Commissioner Gregory agreed saying that he has attended courses which he considered of poor quality. He further stated that he hoped that all providers would develop and deliver credible courses, which represented the construction industry in a professional manner. Chair Browdy stated that hopefully the market will take care of this and licensees will not attend poorly developed and delivered courses.

E. Rule 9B-70.002, Florida Administrative Code, as amended, has been approved and forwarded to the Department of State for filing. It should appear on the system (at www.flrules.org) within the next week.

 

F. As of October 1, 2009, the requirement to take the core course no longer applies to the affected licensees (see below for 2010 legislation). The core course still is and will remain available (for now). DBPR says that there will be no change in how the core course is handled by DBPR. It is now an elective CE course.

 

G. Legislation for 2010 session: starting with the last version of “building codes bill” from last year which is HB 7143 second engrossed (contact Cam at basfanswers@aol.com for a copy by e-mail). This bill includes elimination of core course requirement for the provisions in chapter 553, Florida Statutes, as well as those in the various licensure statutes. The latter passed in HB 425 last year, but the chapter 553 provisions (which were in HB 7143 only) did not.

 

H. An issue has been raised that needs Education POC consideration about advanced codes courses that experience only technical, correcting, or small and minor changes when the code changes. In some cases, the changes are to correct errors made in the adoption of the code itself. Under the current system and rule, any change (even the correcting change of a citation) requires the course be accredited again (costing both time and money). This is a request that the Education POC consider making some allowance (through specified criteria that would require an amendment to rule 9B-70.002) for such changes and allow, for instance, self-affirmation with specific information to update courses without need for additional accreditation and interruption of course delivery. (Please note: For these types of changes, CILB, ECLB, and BCAIB allow for notification without need for resubmitting and additional approval.)
