Product Approval POC Attendees: Ed Carson, Herminio Gonzalez, and Do Kim, Christ Sanidas, Nan Dean, Chris Schulte, Paul Kidwell. Staff present were Mo Madani, Joe Bigelow

The agenda was approved as amended. There was a quorum present. The minutes were amended to state under GFCI Sheds that Kevin Crowley withdrew his request for a Declaratory Statement.

1. Update on prototype program, by Applied Research Associates, Inc. A status report was provided by ARA. However, ARA was not present to present the report. The committee deferred reviewing the report to a later time.

2. Manufactured Buildings Program Issues:

Mike Ashworth, Program Manager provided the committee with a list of possible changes to Rule 9B-1, the Florida Building Code and the statutes as follows:

1.       The issue of intermediate disciplinary authority for mfgrs & 3rd Parties who commit minor or repeat offenses, rather than decertifying them.

2.       The need to modify the language in s 553.375 FS, which  now reads: “ Prior to the relocation, modification or change of occupancy of a manufactured building within the state….” ,  to read: “ Prior to modification or change of occupancy or relocation to a higher wind speed design and construction of a manufactured building within the state , ...........”

3.       Fire safety plan review/inspection residential

4.       Delete Mfgr Disposition report

5.       Change form MBP 1-00 to reflect Public/ Pvt Ed

6.       Delete Insignia Disposition Report

7.       Delete raised seal plans retention in lieu of electronic

8.       Rule 9B-1.006(4)9c) changes

•  s. 553.415(11) need to change to mfgrs data plate vs. DCA insignia 

10.   Precluded foundation plans in MBP plans

11.   ch 428.4.2 change to read posted on the BCIS vs. submit to DCA on CD

RECOMMENDATION :

3. Product Approval Program Issues.

Issue 1 . Cat-5 Net, Non - Impact

Staff reported Application FL6498 was archived September 22, 2006. This product was determined by the committee to outside the scope of Rule 9B-72.

Issue 2 .  BCIS Improvements – Staff provided the committee with a report on the enhancements currently implemented on the BCIS system.

Issue 3 .  At the August 2006 meeting, staff raised concern that products meeting the HVHZ are being approved for use in the non-HVHZ without any substantiating documentation demonstrating compliance with the non-HVHZ portions of the Florida Building Code. The committee discussed the subject but did not make a determination.

Issue 4. Discussed the equivalency of standards and how they should be used in relation to the base standard in the Florida Building Code. The committee discussed the issue and agreed that the manufacturers are permitted to provide for equivalency of standards to an up to date edition of the referenced standard and to the standards edition referenced in the previous edition of the Florida Building Code based on a review for specific case.

Issue 5. Product Approval and Entities Report:  

A report was included in the package for the committee which provided for a number of products and entities approved to date.

Issue 6. Discussion of Declaratory Statement The committee discussed and provided recommendation on the following request for Declaratory Statement:

DCA06-DEC-200 by Warren Schaefer, P.E.

DCA06-DEC-215 by Bruce Kaiser, President, Windtripper.

DCA06-DEC-216 by Eddie Fischer.

4. A&A Report

(A) A&A provided a report with recommendations on four entities for consideration:
1. PRI Construction Materials Technology [Product Testing Laboratory]
2. Spec Testing Inc., dba Specialized Testing [Product Testing Laboratory]
3. Timber Products Testing, Inc. [Product Quality Assurance Entity]
4. Spec Testing Inc., dba Specialized Testing [Product Quality Assurance Entity]

(B). Other Issues:

1. The committee deferred FL7625 to the Structural TAC for review and recommendation with regard to compliance with the codes and standards.

2. The following products were recommended for revocation by the committee:

FL4709, no active QA. Administrator contacted the manufacturer to find a QA and to date, there was no response from the manufacturer.

FL5850, no active QA. Administrator contacted the manufacturer to find a QA and to date, there was no response from the manufacturer.

The committee recommended, based on staff comment, that an email be sent to the manufacturers who have products approved on the old web site, encouraging them to update their approvals to be consisted with the new Rule and web site to eliminate confusion that exists on the web site.
