Section 403.6 Sanitary facilities for public swimming pools. Change to read as shown:

403.6 Sanitary facilities for public swimming pools.  Swimming pools with a bathing load of 20 persons or less may utilize a unisex restroom. Pools with bathing loads of 40 persons or less may utilize two unisex restrooms or meet the requirement of Table 403.6. Unisex restrooms shall meet all the requirements for materials, drainage and signage as indicated in sections 4524.1.6.1.1 through 4524.1.6.1.4 of the FBC, Building.  Each shall include a water closet, a diaper change table, a urinal, and a lavatory. Pools with a bathing load larger than 40 persons shall provide separate sanitary facilities labeled for each sex. The entry doors of all restrooms shall be located within a 200-foot (60 960 mm) walking distance of the nearest water’s edge of each pool served by the facilities.

Exception: Where a swimming pool serves only a designated group of residential dwelling units and not the general public, poolside sanitary facilities are not required if all living units are within a 200 foot horizontal radius of the nearest water's edge, are not over three stories in height unless serviced by an elevator, and are each equipped with private sanitary facilities..

R101.4.3 Additions, alterations, renovations or repairs. Additions, alterations, renovations or repairs to an existing building, building system or portion thereof shall conform to the provisions of this code as they relate to new construction without requiring the unaltered portion(s) of the existing building or building system to comply with this code. Additions, alterations, renovations or repairs shall not create an unsafe or hazardous condition or overload existing building systems. An addition shall be deemed to comply with this code if the addition alone complies or if the existing building and addition comply with this code as a single building.

Exception: The following need not comply provided the energy use of the building is not increased:

1. Storm windows installed over existing fenestration.

2. Glass only replacements in an existing sash and frame.

3. Surface applied window film on existing fenestration assemblies.

4. Existing ceiling, wall or floor cavities exposed during construction provided that these cavities are filled with insulation.

5. Construction where the existing roof, wall or floor cavity is not exposed.

6. Reroofing for roofs where neither the sheathing nor the insulation is exposed. Roofs without insulation in the cavity and where the sheathing or insulation is exposed during reroofing shall be insulated either above or below the sheathing.

7. Replacement of existing doors that separate conditioned space from the exterior shall not require the installation of a vestibule or revolving door, provided, however, that an existing vestibule that separates a conditioned space from the exterior shall not be removed,

8. Alterations that replace less than 50 percent of the luminaires in a space, provided that such alterations do not increase the installed interior lighting power.

9. Alterations that replace only the bulb and ballast within the existing luminaires in a space provided that the alteration does not increase the installed interior lighting power.

10. Swimming pool filtration pumps and motors.

454.1 Public swimming pools and bathing places. Public swimming pools and bathing places shall comply with the design and construction standards of this section. Pools shall not be used by bathers until an operation permit is issued by the Department of Health.

 

454.1.1 Flood hazard areas. Public swimming pools installed in flood hazard areas established in Section 1612.3 shall comply with Section 1612.

 

NOTE: Other administrative and programmatic provisions may apply. See Department of Health (DOH) Rule 64E-9, Florida Administrative Code, and Chapter 514, Florida Statutes. The regulation and enforcement of the initial and annual operation permit for public pools are preempted to the DOH. The construction permit holder is responsible for obtaining an operation permit issued by DOH, as a public swimming pool shall not be put into operation without an inspection and operation permit issued from the DOH. Building Officials must provide notice to the local Department of Health County Health Department upon issuance of a Construction or modification permit, and upon issuance of a certificate of completion or occupancy for public swimming pools and public bathing places as defined in Chapter 514, Florida Statutes.

One of these complaints relates to resurfacing pools, which is not a modification as defined in the FBC, and this is also stated in 424.1.10.1.  Since only new pool construction or modifications are Building Department jurisdictional under the transfer of construction permitting authority at  s.514.031, FS, the DOH should be the only one involved with the resurfacing of existing public pools.    We suggest that you strike the resurfacing details from the FBC including the last sentence at that paragraph above (“However, the following items shall be addressed during resurfacing projects:”) and then delete all of 424.1.10.1.1 through 424.1.10.1.9 , and also delete the next two subparagraphs dealing with other changes that are less than a modification: 424.1.10.2 and 424.1.10.3.
