Discussion: Commissioner Stone stated that questions 2, 5, and 10, which are embedded in the training content, should be worded more clearly. He further stated that he thought the course should be approved and the rest of the ED POC members agreed. Sharon Mignardi, the accreditor for the course, stated that she will make sure the provider receives this information and makes the appropriate revisions.

Course: Advanced 2012 Florida Accessibility Code

Prior Accreditor: BCIC LLC

BCIS Course Number: 316.1

Motion: Course conditionally approved based on the FBC accreditation process that only verifies the accuracy of the Florida Building Code related content, subject to revising the title in the BCIS course description to match the title in both the course syllabus and title slide of the PowerPoint presentation, or vice versa.

Discussion: The Education Administrator stated that the course title in the BCIS course description did not match the course title in the course syllabus or on the first slide of the PowerPoint presentation. The title in the BCIS course description read, “ADV 2012 Florida Accessibility Code”, while the title in the syllabus and first slide of the PowerPoint presentation read, “2012 Florida Accessibility Code for Building Construction”. The ED POC members agreed.

Prior Accreditor: JDB Code Services, Inc.

BCIS Course Number: 499.0

Motion: Course approval deferred because the 2007 code is referenced in the syllabus, the first slide of the PowerPoint needs to be modified or deleted, slides 9,10,and 11 need to be modified, and verbiage needs to be deleted from the method of presentation part of the syllabus.

Discussion: The Education Administrator stated that several changes needed to be made to the course materials. First, the 2007 code is referenced in the header of the syllabus. The header should reference the 2010 code. Second, the first slide of the PowerPoint presentation states that the course would be narrated as an online course. This needs to be deleted or modified because the course is instructor led. Third, on slides 9, 10, and 11 the word “Changed” is placed on the slide, but no changes are referenced. The slides need a more clear explanation of what changed. Fourth, in the “Method of Presentation” part of the syllabus, it is stated that audio clips, video clips, and photographs would be used as part of the instruction. After reviewing the materials, none of these methods of instruction were found. So, this verbiage needs to be deleted. The Education Administrator stated that the course provider was informed by e-mail of concerns and the need to attend this meeting.  The ED POC members agreed that the changes needed to be made.

BCIS Course Number: 500.0

Motion: Course conditionally approved based on the FBC accreditation process that only verifies the accuracy of the Florida Building Code related content, subject to deleting the verbiage regarding “audio clips, video clips, and photographs” in the Method of Presentation part of the syllabus and more clearly explaining what changed on slides 10,11, and 12.

Discussion: The Education Administrator stated that on slides 10, 11, and 12 the word “Changed” is placed prominently on the right side of the slide, but no changes are referenced. The slides need a more clear explanation of what changed. He also stated that in the “Method of Presentation” part of the syllabus, it is stated that audio clips, video clips, and photographs would be used as part of the instruction. After reviewing the materials, none of those methods of instruction were found. So, this verbiage needed to be deleted.

Initially, a motion was made to defer approval of this course. The roll call vote was Kevin Flanagan, Darrell Phillips, and Drew Smith for deferral, and Nan Dean, Jeffrey Stone opposed to deferral. This 3-2 vote did not meet the 75% threshold for approval so a new motion was made for a conditional approval. Those results are listed in the above motion information, and the course was conditionally approved.

Update status of the proposed language changes to Rule 61G20-6.002, F.A.C

 

The General Counsel, April Hammonds, stated that as a result of comments and recommendations made by Med Kopczynski, another revision was made to rule 61G20-6.002, F.A.C.. Specifically, the words “law or administrative rule” were inserted a total of five times next to the words “code,” “building code,” or “code edition.” She asked if there were any questions and stated that those five additions were the only changes made. She further stated that even though these are technical changes that staff has been authorized by the POC to make, she wanted to give the ED POC the opportunity to make a motion to accept those changes.  There were no questions or comments by the ED POC members, and they did make the motion for approval of the revised language.

Education Administrator activity report

Discussion: The Chair asked Cam Fentriss to provide this report. Cam stated that there were 5 inquiries that were handled. She also stated that some revised statutory language related to the Building Code Training Program was enclosed in the report and would be reviewed by the legislature. She asked if there were any questions about the revised language. No questions were forthcoming.

E. Changes are proposed in legislation (HB 593 / SB 1106) to section 553.841, Florida Statutes, as follows (subject to change):

 

553.841 Building code compliance and mitigation program.—

(1) The Legislature finds that knowledge and understanding by persons licensed or employed in the design and construction industries of the importance and need for complying with the Florida Building Code and related laws is vital to the public health, safety, and welfare of this state, especially for protecting consumers and mitigating damage caused by hurricanes to residents and visitors to the state. The Legislature further finds that the Florida Building Code can be effective only if all participants in the design and construction industries maintain a thorough knowledge of the code, code compliance and enforcement, duties related to consumers, and changes that additions thereto which improve construction standards, project completion, and compliance of design and construction to protect against consumer harm, storm damage, and other damage. Consequently, the Legislature finds that there is a need for a program to provide ongoing education and outreach activities concerning compliance with the Florida Building Code, the Florida Fire Prevention Code, construction plan and permitting requirements, construction liens, and hurricane mitigation.

 

(2) The Department of Business and Professional Regulation shall administer a program, designated as the Florida Building Code Compliance and Mitigation Program, to develop, coordinate, and maintain education and outreach to persons required to comply with the Florida Building Code and related provisions as specified in subsection (1) and ensure consistent education, training, and communication of the code's requirements, including, but not limited to, methods for design and construction compliance and mitigation of storm-related damage. The program shall also operate a clearinghouse through which design, construction, and building code enforcement licensees, suppliers, and consumers in this state may find others in order to exchange information relating to mitigation and facilitate repairs in the aftermath of a natural disaster.

General public comment

Jack Glenn asked what the effective date would be for the new rule language for rule 61G20-6.002, F.A.C.  April Hammonds stated that the date will be determined after the “Notice for Proposed Rule” is posted because someone can request a hearing on the rule within 21 days of posting. Then there is a 45 day waiting period until the actual hearing. So the effective date is dependent on what happens after the “notice” is posted.
