Ψ Review of information related to waivers for the purpose of making a recommendation to the Florida Building Commission on the appropriate fee to charge for a waiver application as required by section 553.512(1), F.S., during the workshop to be held by the Commission on Rule 61G20-4.001, F.A.C., to be held May 14 2013 at 10:00 A.M.

Objective

Discussion of objectives included the following: 

1)

10:00 AM - Welcome and Opening, Roll Call.  A quorum was present. Barbara Page made a motion and Larry Schneider made a second to approve the Agenda with a unanimous approval vote.

Jack Humburg made a motion and Barbara Page made a second to approval of the minutes from March 29, 2013 meeting

Reviewed information related to waivers for the purpose of making a recommendation to the Florida Building Commission on the appropriate fee to charge for a waiver application as required by section 553.512(1), F.S.,

 

Option 1: The fee should recover an average administrative cost per application (e.g., $673.00). The cost would be based on an average number of accessibility code waiver applications per year (i.e., five-year average). 4 = Acceptable, I agree – 0 votes, 3 = Acceptable I agree with minor reservations – 0 votes, 2 = Not Acceptable, I don’t agree unless major reservations addressed – 0 votes, 1 = Not Acceptable – 9 votes. Member comment too costly.

 

Option 2: A sliding accessibility code waiver fee schedule should be established to encourage compliance with accessibility requirements, that is based on a disproportionate cost formula factoring the cost of construction relative to area of building ($x/square foot). 4 = Acceptable, I agree – 0 votes, 3 = Acceptable I agree with minor reservations – 1 votes, 2 = Not Acceptable, I don’t agree unless major reservations addressed – 7 votes, 1 = Not Acceptable – 1 votes. Member comment too complicated.

 

Option 3: A nominal fee of $250.00 should be charged to offset but not fully recover administrative costs. 4 = Acceptable, I agree – 6 votes, 3 = Acceptable I agree with minor reservations – 3votes, 2 = Not Acceptable, I don’t agree unless major reservations addressed – 0 votes, 1 = Not Acceptable – 0 votes

 

Option 4: A three tier fee schedule $125.00 for under $250,000.00, $250.00 for $250,000.00 to $1,000,000.00 and $500.00 for over $1,000,000.00. 4 = Acceptable, I agree – 1 votes, 3 = Acceptable I agree with minor reservations – 6 votes, 2 = Not Acceptable, I don’t agree unless major reservations addressed – 2 votes, 1 = Not Acceptable – 0 votes

 

Linda Parnell made a motion and Barbara Page second the motion with a unanimous  vote that the Accessibility TAC recommends that the Florida building Commission implement an Accessibility Code Waiver application fee of $250.00 per application, with a delayed implementation date of July 1, 2014 to allow time for implementation of needed BCIS revisions.
