Description: This is a 2,281 sq. ft. one-story building under roof, 1,961
sq.ft. under conditioned
space, on a 14,000 sq.ft./.32 acre site. The building,
built in 1959, sits on a main thoroughfare (Rt. 60) and is POI-zoned.
Previously owned by two attorneys since 2006, the duplex was converted into a
professional office space and was unoccupied since @2010. The Allen’s purchased
the building on April 29, 2013 as a commercial property to house a tutoring
center in its 14th (now 15th year) of operation.

Summary: $25,000
to prepare building for use and usage change including: general contracting
services, usage application costs, electrical, air conditioning, and
architectural and engineering services.
$18,500 for all mandated alterations
to property and repair/maintenance to interior including: electrical services,
landscaping, and irrigation, two-tier water fountain and signage.
$27,750 for accessibility
alterations already completed or underway to include concrete parking area,
ramp access at two entrances, two altered handicap-accessible bathrooms, and
widened entry way.
NOTE: This includes the majority but
not all of the costs the owners have had to incur in order to meet the mandates
of the City and the County. These costs relate to this waiver request.

There is significant disagreement
between the County and the owners of the building about the degree of
accessibility requirements that should be further imposed on the owners. The
owners have been given the understanding that, by law, a waiver will be
considered (for future work) if a disproportionate amount has already been
spent for accessibility.

Description:
A waiver to allow for no more interior
doorways to be widened; a total of 6 doorways. These doorways lead into 3 small
tutoring rooms, 1 break room, and 2 of the 4 office/tutoring spaces. Two of the
classrooms have had the entryways/hallways and doorways widened for access and
can provide total access to all services for any person with disabilities. Also, if necessary, any supply or material
can be retrieved and brought to any disabled person in the building. In
addition, there are 3 exit/entry exterior doors; all of which are the required
width for compliance. Section 36.304 of 2010 ADA Standards for Accessible

Description: A waiver to leave intact the remaining two(2) of the four(4) bathrooms;
both small existing bathrooms within the two office/tutoring spaces that are
not needed to be made accessible, at opposite ends of the building. Two(2) bathrooms have already been completely renovated for
accessibility. (If this applicant would have known about this
waiver, one of the two bathrooms would have been requested to be waived in
order to provide “*at least one accessible restroom for each sex or a single
unisex restroom”. The cost savings would have been $4,600 plus the
invaluable costs of removing some unique qualities (décor from the 50’s) of

Grounds for Waiver: The Florida Building Commission may grant waivers of
Florida-specific accessibility requirements upon a determination of
unnecessary, unreasonable or extreme hardship. Please describe how this project
meets the following hardship criteria. Explain all that would apply for

hardship is caused by a condition or set of conditions affecting the owner
which does not affect owners in general.
Description:
As has been presented here, the
requirements and ramifications of a usage change from residential to commercial
were not understood by the owners of this building. We have experienced extreme
stress and financial hardship through this lengthy process as we've tried to
comply with all the mandates. Now that we've learned about the possibility of a
waiver, we are hoping to save at least some of the costs associated with ADA
compliance renovations as well as the integrity of this older building.
Substantial
financial costs will be incurred by the owner if the waiver is denied. The
owner has made a diligent investigation into the costs of compliance with the
code, but cannot find an efficient mode of compliance. Provide detailed cost
estimates and, where appropriate, photographs. Cost estimates must include bids
and quotes.
Description:
This is a small business and the only
one of its kind in our fairly small community. Tutoring services are provided
to all ages of students, from pre-school to adult, in all subjects, as well as
to students with special needs. The Center is dedicated to supporting students
in every way possible and that includes providing accessible services to any
student/family who needs or wants our help. For this
reason, Ms. Allen does not turn any student/family away for lack of an ability
to pay. The amount of charitable and discounted services exceeds that of most
other businesses. The excessive and ever-growing costs of this project are
literally threatening to put this "community service" out of
business. This waiver is my last hope.
