TAC Members not Present: Jonathon D. (Jon) Hamrick

Objectives: Discuss and recommend potential research topics, Rule Development Workshop comments, Consideration of Declaratory Statements DS 2013-031and DS 2013-048.

 

Meeting Minutes

Objective

Discussion of objectives included the following: 

1)

 

10:30 AM Welcome and Opening, Roll Call.  A quorum was present.

Mr. Ken Cureton, facilitator for the Florida Building Commission, provided a brief overview of how the agenda items will be presented. The Meeting Minutes for the 6/13/13 Fire TAC meeting and the Agenda for the 8/1/13 Fire TAC were approved unanimously by the committee members.

2)

Research Topics -  TAC Action and Comments – Tony Apfelbeck recommend a potential research topic for consideration by the Commission regarding Draftstopping Performance within Type V combustible concealed attic spaces. Topic was voted unanimous in favor of recommendation to the Commission. (Full text of recommendation is provided as an attachment to these minutes).

Comments Related to the 2013 FBC Update – Comment Items F-1 through F-5 were withdrawn by Mo Madani.

TAC Action and Comments Mod 2013-031 - Motion recommended by Belcher to  support the previous Code Admin TAC recommendations provided during their June 13, 2013 meeting for both questions 1 and 2 as follows:

Question 1a: By adding these elements (sinks, electrical outlets, etc.) does that mean that the status of the exemption used to construct the Chickee without a building permit is null and void?

The answer is YES, adding the elements (sinks, electrical outlets, etc.) to the “Chickee” in question would mean that the “Chickee”  as a structure is no longer in compliance with the literal requirements of section 102.2(h) of the 2010 FBC, Building and therefore would be no longer  exempted from compliance of the FBC.

 

 

To Question 1b: If the answer to question “a” is yes, does that mean that the Chickee structure must get a building permit and comply with the current building codes? 

The answer is YES, the “chickee” in question would be required to demonstrate compliance with the current FBC as applicable. 

 

To Question 2: Does the fact of whether the utility services; electric; plumbing; propane or natural gas appliances are attached or not attached to any part of the structure/Chickee change the interpretation of Question 1?

The answer is NO, the definition of the term “chickee” does not differentiate or provide for allowance to whether the utility services, (electric, plumbing, propane or natural gas appliances) are attached or not attached to any part of the structure/chickee.

 

Vote resulted 7 in favor of Staff recommendations, 2 opposed.

5)

TAC Action and Comments Mod 2013-048 - Motion recommended by Belcher to dismiss Mod 048 due to issues being outside of the scope of Declaratory Statement process for both questions 1 and 2. Voted unanimously to dismiss.

6)

Other TAC Business – Having no other TAC business, the meeting was handed over to the TAC chair for a Motion to Adjourn.
