TAC Members and Objectives

TAC Members Present: Chair Jeffery Gross, Bemmie Eustace, barbara Page, James Woolyhand, and Brad Schiffer

TAC Members not Present: Sharon Mignardi, jack Humburg, Bob Gerwe and Larry Schneider

Staff Present: Mo Madani, Chip Sellers, Mary-Kathryn Smith, Jim Richmond, April Hammonds and Jim hammers

Ø Objectives: To discuss and provide recommendations regarding comments submitted on the proposed amendments to the “Request for Waiver” application and incorporated by reference in 61G20-4.001.01.

Meeting Minutes
Objective	Discussion of objectives included the following:
1)	10:00 AM - Welcome and Opening, Roll Call. A quorum was present. Bemmie Eustace made a motion and Barbara Page made a second to approve the Agenda as amended to remove item #2 of the agenda with a unanimous approval vote.
2)	Approval of the minutes from January 14, 2013 meeting was removed from the agenda due to the fact that the minutes were not available for review by the TAC.
3)	Discussed and provided recommendations regarding comments submitted on the proposed amendments to the “Request for Waiver” application and incorporated by reference in 61G20-4.001.01. The TAC discussed the comments from the Joint Administrative Procedures Committee (JAPC) regarding the “Certification of Applicant”. In their comments JAPC pointed out that the provisions of the certification of applicant appears to be an “Oath” which would require statutory authority and that if no statutory authority for this oath, the Commission may consider using language contained in Section 837.06 FS. TAC Action: Bemmie Eustace made a motion and Barbara page made a second with a unanimous approval vote to replace “swear or affirm” with the word “declare” and further revise the provisions for “Certification of Applicant” using Section 837.06, Florida Statutes.

6)	Member Comment – 1. Inquiry regarding proposed legislation for the purpose of clarification/interpretation of the Florida Accessibility Code (the Code) using the Declaratory Statement process. (Jeff Gross) 2. Inquiry regarding the status of certification of the Code by DOJ. (Bemmie Eustace)
7)	Adjourn 10:14 AM
