Meeting Objectives:
POC Members Present: On the call: Ed Carson -Chair, Paul Kidwell, and Jeffrey Stone. Present at DCA: Commissioner Herminio Gonzalez. DCA Staff present were Mo Madani, Jim Richmond, Joe Bigelow
1. Call to Order -review/approve agenda and February 2nd Minutes.
2. Product Approval Program Issues
A. Product Approval and Entities Statistics Report was
presented by staff
B. Product Approval Administrator’s
Performance survey was presented by DCA staff with 5 favorable
responses and one unfavorable.
C. Staff presented an update on
Commission action from the March 16th
meeting on Hearings on Rule 9B- 72.090 and
9B-72.180 held February 17, 2009.
D. Ted Berman and Associates Contract
discussion item was determined to be a non-issue and was therefore not
addressed at this time
3. Declaratory Statements
DCA08-DEC-345 by James Reed, Southwest Progressive Enterprises, Inc was
dismissed as no further information has been provided by the applicant to
correctly determine the products structural properties.
4. Ted Berman & Associates Report
A.
Review product approval and entity applications was taken up by the POC.
B. Product Approval Applications
with Comments.
5. Public comment – Jaime
Gascon, the public did not get sufficient time for review of the list of
applications posted as supplement. Start
enforcing provisions that are in the Rule for Validators.
Terry Wolfe – on behalf of Stanek windows, would
like to have application FL 11448 be considered due to fact that it was
complete by the deadline and it was not included on the list of completed
application due to an oversight.
Ted Berman – FL 11448 was the very last application
to come in. Essentially met the
deadline. Was not on the agenda due to
an inadvertence.
Chris Langley – it seems that some applications are
coming in under the rug but it appears this was submitted in compliance with
the Rule
Ted Berman – The ones where the certificate of
independences was missing – there was a lot of back and forth.
Mo Madani – in two months there were 550 applications
reviewed. There needs to be enough time
to review applications. May be we need
to revisit the process and make improvement to allow for enough review time.
The POC considered FL 11448 and recommended the
product for approval.

Product Approval POC:
The Committee recommends the products listed in
Administrator's report be approved, deferred, conditionally approved or denied
as per voted on by the Committee. Including the addition and approval of FL
11448.
