updated courses for recommendation to the Commission

7. Review/discuss draft language
regarding Rule 9B-70.002 (3) (f) (g) (link), F.A.C., which focuses on the
various types of course approvals, specifically addressing the “no changes” and
“affirmation of revision…” categories.
The Chair
stated that agenda item’s 7 and 8, would be discussed together. He recommended
that the POC address item 8 first, then discuss item 7. Item 8 was the
Education Administrator’s report. The Chair asked Cam Fentriss to give said
report.
Cam
reviewed/explained two options regarding how to use two course
update/modification mechanisms commonly known as “reviewed, no change” or
“self-affirmed” for updating or making a technical change to a course.
She explained
that Option One would move the “reviewed, no change” language from subsection
(f) to subsection (g), where the “self-affirmation” language exists, to now
generally read…that a course with no changes would be self-affirmed…or with one
change would be self-affirmed…with both being approved by the Education
Administrator, or if technical advice is needed, by the FBC staff.
Cam further
explained that for Option Two, subsection (f) would be modified to include
self-affirmation for “reviewed, no change” and subsection (g) would basically
remain the same.
The Chair
asked if the administrative staff could be used for technical advice, if that
advice was needed as a result of a review. Cam stated that language was
included for staff to be used for technical reviews.
After some
discussion by the POC members, all agreed that Option One would be their
preference as acceptable language, with a unanimous vote to bolster their
agreement.
Cam stated that
another change involved abandoned courses within the BCIS, of which many were
obsolete. She stated that what is being proposed is to archive courses after
180 days, if providers have not taken any action with those courses.
Joe Belcher,
a provider/accreditor, stated that he has had courses linger in the
system---and asked if this would take care of those courses. Larry Schneider,
another provider, asked if a notice could be sent to providers, letting them
know about the 180 days---and subsequent to archiving of their course(s).
Cam Fentriss
suggested that a notice could be sent to providers, 30 days prior to the 180
day deadline. The Chair asked if a rule change was needed for this to occur.
Cam stated that this could be done administratively within BCIS, meaning an
email could be sent to providers at the 30 day mark, again, prior to the 180
day deadline. All of the POC members
agreed with this action.
Cam stated
that one other change is being proposed, that is to strike the word “advanced”
in subsection (a), because the Education POC reviews all types of code courses,
not just advanced.
Larry
Schneider stated that he and his constituency are against striking the word
“advanced”, because of “board requirements”. A suggestion was made to add the
words “or other code courses”, instead of striking the word “advanced”.
Everyone seemed to agree that this compromise was acceptable.
The Chair
asked for a formal motion to the Commission, to start the Rule Workshop
process, regarding the previously discussed proposed rule changes.

E. FBC Education POC Agenda Item 7 for
review and discussion of proposed draft changes for two course
update/modification mechanisms commonly known as “reviewed, no change ”or
“self-affirmed” for updating or making a technical change to a course.
Below
please find two options for changing the "reviewed, no change"
mechanism to require administrative approval and FBC ratification. After these
two options, please find another proposed draft change to address two things:
-Removal of
the term "advanced" in rule 9B-70.002(3)(a) to better reflect the
role of the FBC and Education POC in approving more than just advanced codes
courses
-Addition
of sentence "If a provider has not taken any action on a submitted
application in180 days, the Commission may withdraw the application." at the
end of rule 9B-70.002(3)(e) to allow archiving of course applications that a
provider does not intend to complete (currently, these course applications stay
in the system and removal would reduce confusion).
OPTION ONE
9B-70.002 Commission Approval and
Accreditation of Advanced Building Code Training Courses.
(3) Training Provider Registration and
Requirements.
(f) On or
before the effective date of changes to the Florida Building Code, providers
shall either designate on the Building Code Information System at
www.floridabuilding.org that the course is not affected by the code changes or update
the existing accredited courses affected by the code changes and submit
for accreditation on the Building Code Information System at
www.floridabuilding.org. If the course is not affected by the code
changes, the course’s status shall remain active. The code version that
initiated the update and reaccreditation process
must be noted on the application.
Accreditation of revisions to approved accredited courses shall be accomplished
in the same manner as described in paragraphs (a) through (f) hereof, except that
only the revision submitted shall be subject to review. and t These
courses shall be approved by the administrator of the education program subject
to ratification by the Florida Building Commission.
(g) If an
approved accredited course is not affected by the code change or
requires revision to correct or update a reference, table, diagram, or quoted
provision of code, law, or administrative rule, the training provider may
submit the revised course and shall complete Form FBC-ED-002,
effective September 10, 2010, adopted herein by reference and available from
the Building Code Information System at www.floridabuilding.org. The code
version must be noted on the application. If a correction or
update is required, the training provider must list the exact change
correction or update, the specific location of the change correction
or update, and reason for the change in the
course and affirm this is the only change correction or update to the
course. The changes correction or update to the course shall
be approved by the administrator of the education program or Florida Building
Commission staff subject to ratification by the Florida Building Commission.
OPTION TWO
9B-70.002 Commission Approval and
Accreditation of Advanced Building Code Training Courses.
(3) Training Provider Registration and

(f) On or

OTHER PROPOSED RULE CHANGES
9B-70.002 Commission Approval and Accreditation
of Advanced Building Code Training Courses.
(3) Training Provider Registration and
Requirements.
(a)
Training providers approved by the Department of Business and Professional Regulation
who desire Commission approval and accreditation for advanced building
code courses shall register with the Building Code Information System using the
Register Training Provider function and associated online screens, Form FBC-ED-002,
effective September 10, 2010, adopted herein by reference and available from the
Building Code Information System at www.floridabuilding.org/ce/ce_tporgapp_dtl1.aspx,
and pay a registration fee of $25.00.

(e)
The Building Code Information System www.floridabuilding.org shall assign an accreditation
number to the application upon submittal. The application shall be accredited completely
and placed in the “Pending FBC Action” file on the Building Code Information System
at www.floridabuilding.org no later than 23 calendar days prior to the next
scheduled meeting of the Florida Building Commission. The Commission shall
finalize the accreditation process utilizing the Building Code Information
System at www.floridabuilding.org and notify the provider and accreditor within
3 business days of the Florida Building Commission’s action on the
applications. If a provider has not taken any documented affirmative action
on the Building Code Information System on a submitted application in 180 days,
the Commission may withdraw the application.

of August 21, 2011, we have 198 training providers* and 12 accreditors

21, 2011, we have 340 approved courses (some are likely obsolete)
