            The TAC convened with a quorum to review the following requests for declaratory statements.

 

DCA 10-DEC 214 Bemmie Eustace, Interplan LLC, Petitioner is requesting clarification regarding Section 11-2.2 of the Florida Building Code. The request asked if it would be considered equivalent facilitation to allow use of the 2010 ADAAG guidelines, which would permit the door of an toilet room to encroach on the clear floor space for toilet fixtures if, as allowed under the new guidelines, the room is for individual use and there is a 30” x 48” area outside the arc of the door.

 

Question:  Is the toilet room configuration requirement of the federal 2010 Standards for Accessible Design an acceptable alternative under the Florida Building Code, Chapter 11, Section 11-2.2 equivalent facilitation?”

 

Answer:    No.  Acceptable means, “Acceptable to the code official or authority having jurisdiction: The code official charged with the administration and enforcement of thus code is the local building official or his/her authorized representative.

 

DCA 10-DEC 285, Larry Schneider, Petitioner, is requesting clarification regarding the use of federal Standards for Accessible Design in lieu of Chapter 11, Florida Building Code. The request asked if it would be equivalent facilitation to use the 2010 ADAAG guidelines for hospital construction of a project projected to last 48 months and is undertaken to fulfill a final order of the court.

 

Question:  Is the use of the 2010 federal Standards for Accessible Design acceptable as equivalent to Chapter 11, Florida Building Code, Building?

 

Answer:  Acceptable means, “Acceptable to the code official or authority having jurisdiction.  The code official charged with the administration and enforcement of this

 

DCA 10-DEC 286, Larry Schneider, Petitioner, is requesting clarification regarding the use of federal Standards for Accessible Design in lieu of Chapter 11, Florida Building Code. The request asked if it would be equivalent facilitation to use the 2010 ADAAG guidelines for hospital construction of a five year project undertaken to fulfill a final order of the court.

 

Question:  Is the use of the 2010 federal Standards for Accessible Design acceptable as equivalent to Chapter 11, Florida Building Code, Building?

 

Answer:  Acceptable means, “Acceptable to the code official or authority having jurisdiction.  The code official charged with the administration and enforcement of this code is the local building official or his/her authorized representative.”
