FLORIDA BUILDING CODE BINDING INTERPREATION

Local code interpretation is requiring 1 hour rated fire wall between occupancies in mixed use as defined by 302.3 and 302.3.2, which should not be required since the building is defined per non-separated uses per 302.3.1. Installation of such fire ratings is burdensome to the project and owner.

Answer:

A binding interpretation may not be rendered at this time, per Florida Statute 553.775

Commentary:

Larry Fuhrman, Building Official for the City of Titusville has stated a local Board of Adjustments and Appeals exists and this case has not yet been submitted to that body.
