The requirements from which the Petitioner seeks a waiver are those in Florida Americans with Disabilities Accessibility Implementation Act (the Act), Section 553.509, Florida Statutes, which require the Petitioner to provide vertical accessibility to all levels above and below the occupiable grade level of a building, structure, or facility. Specifically, Petitioner requests a waiver from providing vertical accessibility to the second floor of an existing historic commercial building.

Locally designated building is considered a contributing structure to the Flamingo Park Historic District. Exterior modifications are generally not allowed for the exception of the construction of one (1) ADA compliant ramp that leads to one(1) ADA compliant dwelling. Vertical access cannot be accommodated for the remaining seven (7) dwellings.

This is an existing building where we are providing one (1) ADA compliant unit of eight (8) units total. Vertical access is provided for the one (1) ADA unit, however, it is not possible the entire building be accessible. It is neither possible to install an elevator that could be accessed at street level.
