Jim Richmond opened the meeting at 10:05 pm., EST, Monday, April 29, 2013.  Roll was called and a quorum was determined.

 

Chairman Browdy advised Jim had provided an updated matrix that was sent to the Commissioners.  Chair Browdy asked that Jim provide updates and address any questions or comments from the members.

 

Mr. Richmond stated the biggest bills moving are Senate Bill 156 and House Bill 1245.  Jim advised that SB 156 is on the Special Order Calendar for today and is substantially similar to HB 1245 as it is now.   He stated HB 1245 was heard on Friday in the House, the amendment in the matrix was adopted, and contains the same language as SB 156, and includes some additional elements, these were added because the language was included in other bills and then pushed into this bill.  Jim detailed the additional language and changes with the Commission.  He stated this is the third reading; one of the bills needs to get passed out to be taken up in the chamber and complete the merge for final passage.

Chair Browdy asked if the concrete masonry council in the revision of language have any affect on the fee setting.

 

Mr. Richmond responded yes, the revision eliminated the referendum on the amount of assessment and rendered it totally voluntary by members of that industry.  He noted that the language has been dropped from both the House and Senate side.  Discussion followed on when the bill will be taken up on either side.  Status of Bill 156 was discussed and where the bills will go prior to being sent to the Governor.

 

Chair Browdy inquired about “our” bill which was mostly contained in Rep. Davis’ original legislation.  He stated it has survived and is now included in other bills. Chair Browdy further stated it looks like the Commission may get some legislative direction this year.

Mr. Richmond stated Rep. Davis’ bill is still active and appears to be in good shape.

Chair Browdy asked about the Ever’s Bill 1080.

Mr. Richmond stated it was amended in Committee, the amendment is contained in HB 1245 and it remained as a traveling amendment, so the attention was turned over to the Senate.  Jim explained the process.

Floor opened for Commissioner questions.

Commissioner Schiffer asked if there is still language appointing an additional Commissioner member for Natural Gas.

Mr. Richmond advised yes, it is contained in HB 1245.

Commissioner Palacios asked if there was any further information on the Wind Exception.

Mr. Richmond advised no.

 

Mr. Richmond discussed HB 973 has passed out of the House and the Senate and has been sent to the Governor’s desk for consideration.  He stated the companion bill is SB 1442.

 

Jim stated SB 1770 includes language that refers to code-plus criteria developed by the Commission in 2007 and reported to the legislature in the 2008 annual report and impose those requirements as a condition for obtaining Citizen’s coverage for new construction after 7/1/13.  At this point it one element of the Senate bill would re-impose that, it was on the table to be re-imposed in 2009, and he believed that was repealed before it took effect.   At this point it would seek to resurrect the code plus language and have it applied to property seaward of the coastal construction control line.  He pointed out history included on matrix.  He said HB 835 does not include code language.

Chair Browdy asked that Jim cover the meetings coming up for mandate for rule making for fees.

Jim provided the background on the rule making and the JAPC recent concern that the rule be adopted by July 1st.  He advised there is a scheduled meeting for the Accessibility TAC to set fees to be recommended to the Commission.  There is a meeting scheduled for May 14th at 10 am to hear the recommendations through a noticed rules workshop and allow for public comment.

Chairman Browdy asked if there are any further questions.

 

Jeff Blair asked if SB 156 included the definition of local technical amendment.

Jim advised, yes it is included.

Mr. Richmond advised there is no call next Monday, however there is a call the following Monday, May 13th and there will be a reminder sent out for the call.  This call will be a follow up from Session ending.
